MINUTES OF THE MOORESVILLE BOARD OF ZONING APPEALS <br /> <br /> The Mooresville Board of Zoning Appeals met at its regularly scheduled <br />meeting the 17th day of October, 19~4, at the Mooresville Town Hall. Present <br />were Board Members, Steve Oschman, Wendell Thaler, Warren Franklin, Tilford <br />Bailey, and Paul Walters. Also present was the Board's Attorney, Timothy C. <br />Currens. Chairman Oschman determined that there was a quorum present and opened <br />the meeting. The minutes of the prior meeting were approved along with the <br />findings of fact presented. <br /> <br /> The Board proceeded with the first item on the agenda, deliberations on <br />the special exception request of Harry F. Tidler and Delores A. Tidler and <br />Robert Burden and Geraldine A. Burden for a special exception to remove top <br />soil from a part of the acreage in question for the purpose of filing an 11 1/2 <br />acre tract just north of the area where the special exception is being requested, <br />with the second part being a request to remove and m~ne sand and gravel from a <br />part of the 90 acre tract with the final request being for the area to be a <br />recreational lake. Chairman Oschman then opened up the deliberations by suggesting <br />that the Board review the special exception requirement listed under the Town's <br />ordinance. Item 1, of the 6 requirements was then discussed with Tilford Bailey <br />pointing out that the mining and development of a lake within 75 feet of the <br />creek and 100 feet of the homes could create a safety factor which would be <br />detrimental to the children in the area. Wendell Thaler pointed out that the <br />actual water would not be quite that close and the creek already presented a <br />water safety situation. Tilford Bailey pointed out that this would be deeper <br />water. Steve Oschman said that this would be somewhat of an unknown. Wendell <br />Thaler suggest as to the issue of contamination based upon the testimony of <br /> <br /> <br />
