MINUTES OF THE MOORESVILLE BOARD OF ZONING APPEALS <br /> <br /> The Mooresville Board of Zoning Appeals met at its regularly <br />scheduled meeting the 21st day of November, 1984 at the Mooresville <br />Town Hall. Present were Board Members, Paul Walters, Tilford Bailey, <br />Wendell Thaler, and Warren Franklin. Present on behalf of Board <br />Attorney Timothy C. Currens was Attorney Michael A. Ksenak. Vice <br />Chairman Wendell Thaler determined that there was a quorum and opened <br />the meeting. The minutes of the prior meeting were approved. <br /> <br /> The Board proceed with the first item on the agenda, the approval <br />of the findings of fact from the prior meeting. Attorney Ksenak <br />pointed out that with regards to the findings of fact concerning the <br />petition for special exception of Harry F. Tidler and Delores A. Tidler <br />and Robert Burden and Geraldine A. Burden, there had not been a specific <br />finding as to Item i under the Mooresville Zoning Ordinance under <br />Chapter 5 - Special Exception Procedures, that "the establishment, <br />maintenance, or operation of the special exception will not be detrimental <br />to or endanger the public health, safety, moral, or general welfare." <br />Vice Chairman Thaler summarized his recollection of the facts and <br />evidence presented by either side concerning Item 1 and opened the <br />matter up for discussion. The members of the board unanimously agreed <br />with Vice Chairman Thaler's summary that the evidence and facts presented <br />did not support a finding that the proposed use was not detrimental to or <br />endanger the public health, safety, morals, or general welfare. Chairman <br />Thaler then moved on to the second item on the agenda, approval of the <br />findings of fact of the October 17, 1984 meeting. A motion was made by <br /> <br /> <br />
