MOO RESVILLE BOARD OF ZONING APPEALS

The Mooresville Board of Zoning Appeals met in a special session
on the 22nd day of March, 1979, at 7:30 P.M.

The following Board members were present:

Mr. Steve Edwards
Mrs. Nan Kollmeyer
Mr. Paul Walters
Mr. Warren Franklin

The Board's attorney, Mr. David E. Lawson, was present.

The Minutes of the prior meeting in October, 1978, were read and
approved.

Mr. Steve Edwards, as Chairman, indicated that the Board had con-
vened to hear evidence on Petition #1-1979 filed by Robert L. and
Nancy A. Heath. Mr. Heath was present with his counsel, Mr Steve
Harris.

Mr. Lawson advised that the petition was procedurally in order with
adequate notice given pursuant to the rules of the Board.

Evidence on behalf of the petitioner was presented by Mr. Steve
Harris.

The following individuals were heard as interested parties concern-
ing the variance request.

1. Mr. Fred Glidden appeared and spoke for his mother, Mrs. Berniece
Glidden, who resides at 60 East South Street. Mr. Glidden believes
that placing the rental unit on the lot by the Heath's would diminish
the value of the adjoining property owners: He objected to the home
being placed and to front an alley. Mr. Glidden indicated to the
Board that if this procedure were allowed to divide the lot for the
purposes of placing two residences on the property that it would be
a stepping stone for this type of procedure in the neighborhood. He
felt that the zoning regulations should be upheld and this type of
variance not be permitted.

2. Mr. Charles Lieber, 32 E. South Street, appeared. He opposed
the variance and felt that there would be a parking problem created
by the same.

3. Mr. Horace E. Adams, 35 E. South Street, appeared in opposition
to the variance. He supported the comments made when Mr, Glidden
felt that it would diminish the value of his property and adjoining
property in the area.
