Allison <br />Revocable Living Trust <br />Rezoning <br />WHEREAS, this rezoning was requested by George T. Allison and Clara C. <br />Allison, Trustees of the George T. Allison and Clara C. Allison Revocable Living <br />Trust, dated November 15, 2019, being all owners of the subject property and giving <br />consent, and <br />WHEREAS, the Town of Mooresville Plan Commission, pursuant to Indiana Code <br />37-7-4 did, on April 8, 2021 hold a legally advertised public hearing on said request and <br />has certified an unfavorable recommendation to the Town Council of Town of <br />Mooresville, and <br />WHEREAS, the Mooresville Town Council, after diligent review of the <br />matters pertaining to rezoning of the above described land at a public hearing <br />held on the 18t" day of May, 2021 find that the requested zoning classification, <br />with voluntary commitments, is appropriate. <br />NOWTHEREFORE BE IT ORDAINED by the Town Council of the Town of <br />Mooresville, Indiana as follows: <br />SECTION 1: Official Zoning Map <br />The zoning classification of the real estate as described in Exhibit 'A' which is within the <br />zoning jurisdiction of Town of Mooresville, Indiana, shall be changed from 11 Light <br />Intensity Industrial to R1 -d Single -Family Residential, with voluntary commitments per <br />attached Exhibit 'B' <br />SECTION 2: Commitment(s) <br />Voluntary commitments per Indiana Code 36-7-4-1015 and as shown in attached <br />Exhibit '13' shall run with the land and be binding upon owners, their heirs, successors <br />and assigns. <br />SECTION 3: Repealer <br />All ordinances or parts thereof in conflict with this ordinance shall be repealed to the extent of <br />such conflict. <br />71 Pu <br />--a-a� <br />
