ORDINANCE # 14-2021 AN ORDINANCE LIFTING THE SUSPENSION OF LATE FEES PERTAINING TO THE TOWN'S WASTEWATER UTILITY WHEREAS, the Town Council of the Civil Town of Mooresville, Indiana operates the wastewater treatment plant on behalf of the citizens of the Town of Mooresville; WHEREAS, on July 20, 2010, the Town Council adopted Ordinance 8, titled An Ordinance Establishing A Schedule Of Rates And Charges To Be Collected By The Town Of Mooresville From The Owners Of'Property Served By The Sanitary Treatment Plan Of The Town Of Mooresville, which established and adjusted rates and charges for the maintenance and operation of the wastewater treatment plan; WHEREAS, on March 6, 2020, the State of Indiana declared a public health emergency in the State as a result of the novel Coronavirus Disease 2019 ("COVID-19") outbreak in Indiana, throughout the United States and worldwide; WHEREAS, on or about March 20, 2020, due to the State-wide public health emergency, the Town Council passed Ordinance 4-2020 which temporarily suspended Section 7(c) of Ordinance 8, which states as follows: As provided by statute, all rates and charges not paid when due are hereby declared to be delinquent and a penalty of ten percent (10%) of the amount of the rates or charges shall thereupon attach thereto. The time at which such rates or charges shall be paid is now fixed at fifteen (15) days after the date of mailing of the bill. WHEREAS, the Town Council has determined that the impacts of COVID-19 have mitigated to the point where it is in the best interest of the Town to lift the suspension of Section 7(c) of Ordinance 8. BE IT HEREBY ORDAINED BY THE TOWN COUNCIL OF THE CIVIL TOWN OF MOORESVILLE THE FOLLOWING: 1. That upon adoption and execution of this Ordinance, the impact of Ordinance 4- 2020, suspending penalties of Section 7(c) of Ordinance 8, shall be terminated.
