Mooresville Plan Commission <br />Thursday September 81h, 2022 <br />Members present: David Saddler, Tammy VanHook, Mark Taylor, JD Robinson, <br />Jeff Dieterlen, Josh Brown, Robert Alumbaugh and Taft Law attorney Cameron <br />Starnes. Mike Young and Kim Scofield were absent. <br />David Saddler called the meeting to order requesting a motion on the previous <br />minutes; Josh Brown made a motion to approve minutes as presented, JD Robinson <br />seconded and the minutes were accepted with a 7-0 vote. <br />First agenda item: John Larrison, on behalf of Christopher Reed presented a <br />request for a 4 -lot plat at 6647 E. Bens Dr. The request is to split the existing 15.70 <br />acres into the following: lot 1 @ 2.0 acres, lot 2 @ 9.660 acres, lot 3 @ 2.0 acres <br />and lot 4 @ 2.Oacres. Mr. Larrison explained that Mr. Reed is not the first owner of <br />this property, that neither Mr. Reed nor previous owners are part of the Hadley <br />Road Farm Estates Homeowners Association or part of the Ben's Drive Road <br />Association. Mr. Larrison further stated that the roadway had been changed <br />slightly from the previously submitted plat plans and would utilize Mr. Reeds <br />existing drive. David Saddler called for questions and or comments: Member Mark <br />Taylor confirmed all construction traffic would use Mr. Reeds drive. Several <br />members of audience (audience members list to follow) expressed concerns for use <br />of the road, asking that Mr. Reed and the other lots contribute annually, equally to <br />Bens Drive road maintenance, others stated concerns for the possibility of mobile <br />homes and asked that homes be built similar to the current HOA covenance and <br />restrictions, there was discussion of the culvert as well. David Saddler requested <br />attorney Starnes explain to the audience the specific job of the Plan Commission <br />regarding this petition; to determine if Mr. Reed can split his property into the <br />requested lots. When audience members again began to speak Tammy VanHook <br />reiterated what Mr. Starnes had said, the Plan Commission cannot enforce road <br />maintenance costs, or building guides based on an HOA the property is not a part <br />of, Mr. Larrison previously stating all homes would meet the AG requirements. <br />When no further questions or comments were made David Saddler called for a <br />vote: JD Robinson made the motion to accept the revised plat, Tammy VanHook <br />seconded and the motion passed 7-0. <br />
