ORDINANCE NO. 12-2022 AN ORDINANCE RECERTIFYING THE CURRENT LEGISLATIVE BODY DISTRICTS OF THE TOWN OF MOORESVILLE, INDIANA WHEREAS, the Town of Mooresville, Indiana ("Town") is divided into five (5) legislative body districts for the purpose of electing Town Council members ("Districts"); WHEREAS, the current Districts are set forth in the attached Exhibit A, which is incorporated herein by this reference; WHEREAS, the Town Districts must comply with the standards set out in Ind. Code § 36-5-2-4.1(b); WHEREAS, Ind. Code § 3-5-10-7 requires the Town to redistrict its election districts from the 2020 decennial census by December 31, 2022; WHEREAS, in accordance with Ind. Code § 3-5-10-8, a redistricting authority is not required to redistrict if the applicable statute provides that the redistricting authority may certify that the existing districts continue to satisfy all the requirements of the applicable statute and other applicable law; WHEREAS, the applicable statute, Ind. Code § 36-5-2-4.1(j), allows the legislative body to adopt an ordinance recertifying that the districts as drawn comply with Ind. Code § 36-5-2-4.1(b); WHEREAS, the Town Council hereby finds that a redistricting of the Districts is not required because the Districts, as currently draw, continue to satisfy all the requirements of Ind. Code § 36-5-2-4.1(b); WHEREAS, the Town Council now desires to recertify that the Districts, as currently drawn and set out in Exhibit A, comply with Ind. Code § 36-5-2-4.1(b); NOW THEREFORE, be it ordained by the Town Council of the Town of Mooresville, Indiana that: Section 1. The above recitals are incorporated herein by this reference as though fully set forth herein below.
