TOWN OF MOORESVILLE <br />RESOLUTION NO: .2 - Zo ;,)3 <br />A RESOLUTION TO OPT IN TO OPIOIDS GLOBAL SETTLEMENT <br />WITH TEVA ALLERGAN CVS WALGREENS AND WALMART <br />WHEREAS, the Town of Mooresville (the "Town") is a political subdivision <br />existing under the provisions of Ind. Code § 36-4-1, et. seq.; <br />WHEREAS, the Mooresville Town Council (the "Council") is the fiscal body of <br />the Town; <br />WHEREAS, the Town has been actively engaged in pursuing damages caused by <br />the manufacture, sale, and distribution of opioids through outside counsel in <br />multidistrict litigation; and <br />WHEREAS, recent legislation amending Indiana Code 4-6-15 has been adopted <br />by the Indiana legislature; <br />WHEREAS, the Town, after due consideration of said legislation, determined <br />that it was in the best interest of its citizens to opt back in to the opioids' settlements <br />under Indiana Code 4-6-15-2 in relation to a global settlement with distributors; and <br />WHEREAS, there has been an additional opioid settlement with Teva, Allergan, <br />CVS, Walgreens, and Walmart modeling the same distribution and settlement <br />procedures as the previous settlement. The Town, has determined that it is in the best <br />interest of its citizens to opt in to the additional opioids' settlements under Indiana <br />Code 4-6-15-2 and any subsequent legislation. <br />
