Meso%�;a� zt z3 <br />A RESOLUTION OF THE TOWN COUNCIL OF THE TOWN OF MOORESVILLE <br />INDIANA ACCEPTING THE TERMINATION OF TAX ABATEMENT FOR A 75,000 <br />SQ. FT. BUILDING LOCATED AT HAYMAKER DRIVE, MOORESVILLE <br />MORGAN COUNTY, INDIANA <br />WHEREAS, I.C. § 6-1.1-12.1-4 authorizes partial abatement of real property taxes <br />attributable to improvements made to real estate; and <br />WHEREAS, in 2019, the Mooresville Redevelopment Commission of the Town of <br />Mooresville, Indiana ("RDC") filed an Indiana Statement of Benefits Real Estate <br />Improvements Property form (the "SB -1 Form") certifying redevelopment or <br />rehabilitation of real estate improvements ("Commitments") for a 75,000 sq. ft. shell <br />building located on Haymaker Drive, Mooresville, Indiana ("Property"). A copy of the <br />SB -1 Form is attached hereto and incorporated herein by this reference as Exhibit A; and <br />WHEREAS, in reliance on the Commitments, on or around October, 2019, the <br />Town Council of the Town of Mooresville, Indiana ("Council") approved a 10 -year real <br />property tax abatement for the Property ("Abatement"); and <br />4 <br />WHEREAS, the RDC is in the process of selling the Property and in furtherance <br />thereof, consented to the rescission of the Abatement at their April 6, 2023 meeting; and <br />WHEREAS, as a result of the RDC's request, the Abatement previously authorized <br />and provided to the RDC in 2019 is hereby terminated for the remaining scheduled years <br />beginning in 2023. <br />NOW, THEREFORE, BE IT RESOLVED, by the Town Council of the Town of <br />Mooresville, Indiana, as follows: <br />Section 1. The foregoing Recitals are incorporated herein by this reference. <br />Section 2. The Tax Abatement previously approved and provided to the Town <br />of Mooresville Redevelopment Commission by the Council should be and the same is <br />hereby TERMINATED for the remainder of the scheduled years of the Tax Abatement <br />beginning in the calendar year 2023. <br />Section 3. The Clerk is directed to mail a certified copy of this Resolution to the <br />Town of Mooresville Redevelopment Commission, the Morgan County Auditor, and the <br />Morgan County Assessor. <br />
