Y <br />May 16, 2023 <br />The Mooresville Town Council met in regular session on Tuesday, May 16, 2023, at 6:30pm at <br />the Mooresville Government Center. <br />Council Members present were President, Tom Warthen and Councilmen Greg Swinney, Jeff <br />Cook and Josh Brown. Councilman Shane Williams was absent. Attorney, Chou-il Lee was also <br />present. <br />Tom Warthen gave the invocation and called the meeting to order. <br />Approval of the minutes from the May 2, 2023 meeting — Motion was made by Councilman <br />Brown, second by Councilman Swinney to approve the minutes as written. Motion carried 4-0. <br />Baker Tilly Annexation Fiscal Plan —The Annexation Fiscal Plan for the Lasiter property was <br />presented for approval. <br />A motion to approve the plan was made by Councilman Swinney and second by Councilman <br />Brown. Motion carried 4-0. <br />Public Hearing Ordinance 6-2023 — President Warthen opened the public hearing for the <br />consideration of Ordinance 6-2023, the annexation of the Lasiter property. There were no <br />comments. <br />A motion to approve Ordinance 6-2023 was made by Councilman Swinney and second by <br />Councilman Brown. Motion carried 4-0. <br />RFPQ for HVAC Analysis Project—There were two RFPQ's received. One from Trane and one <br />from Ameresco. Per Attorney Lee, the next step would be to form a committee to review. <br />President Warthen stated the committee would consist of himself, the Clerk -Treasurer or <br />someone from her office, Dave Moore, Tim Bennett and Greg Swinney. <br />Regina Shelby Street Fair Rescheduling — The May 13" Street Fair was postponed due to the <br />threat of inclement weather. Regina stated she had spoken to Halle from 5 East and the only <br />date she had available was October 29th. The Street Fair will run on that day from 1-5 pm. <br />Regina will send out a new street closing permit for department head approval. <br />Nice -Pak Wastewater fees — Representing Nice -Pak were Brett Dennemann, Plant Controller <br />and Ryan Brasche, Sr. Director of Operations. They were asking for the Council's consideration <br />in adjusting the discount Nice -Pak currently receives on their wastewater bill. The discount is <br />currently set at 28%, meaning their bill is based upon 72% of their water usage. This is to allow <br />for the amount of water that goes into their product. Mr. Dennemann stated that they have <br />gone back 5 years and done calculations and he believes the number is closer to half of what <br />they are being billed currently, due to the fact that their product is 99% water. President <br />Warthen stated that these numbers were all discussed as recently as two to three years ago <br />when Nice -Pak was considering moving and at that time representatives from Nice -Pak stated <br />those figures were still accurate but they were going to be looking at better equipment that <br />would result in them discharging less water. President Warthen stated they were key players in <br />the rate evaluation and those rates affect all rate payers in the Town. Mr. Dennemann stated <br />they were not privy to those conversations and they are looking to have a conversation going <br />forward. Mr. Brasche stated that they would also be open to the idea of a dual meter or other <br />means. President Warthen asked the Council for permission to have a conversation with Nice - <br />Pak and it was the consensus of the Council for him to do that. <br />Buffers USA, Inc. SB -1's for Real and Personal Property— Mike Dellinger, Executive Director of <br />Morgan County EDC stated that Buffers USA is the buyer of the RDC's spec building in Flagstaff <br />Business Park. The RDC had a 10 year tax abatement on the real property and it was rescinded <br />recently by the Council. Buffers USA will bring approximately 15 jobs to Mooresville. The <br />abatement would be approximately $3.5 million for the finish out of the building and $350,000 <br />for personal property. <br />
