MOORESVILLE TOWN COUNCIL <br />RESOLUTION NO. 2 rO ®7 <br />A RESOLUTION OF THE TOWN OF MOORESVILLE, INDIANA AND THE <br />MOORESVILLE CONSOLODATED SCHOOL CORPORATION REGARDING AN <br />INTRAGOVERNMENTAL TRANSFER OF REAL PROPERTY <br />WHEREAS, the Town of Mooresville, Indiana (hereinafter, the "Town') is a <br />political subdivision of the State of Indiana; and <br />WHEREAS, the Mooresville Consolidated School Corporation is an agency of a <br />political subdivision (hereinafter, the "School"); and <br />WHEREAS, the Town desires to implement a road project along Monroe Street, <br />Mooresville, Indiana ("Project"); and <br />WHEREAS, the School is the fee simple owner of certain property more <br />particularly described in a legal description set forth in Exhibit A, attached hereto and <br />incorporated by reference, which property is located within the Town of Mooresville, <br />Hendricks County, Indiana and is situate adjacent to Monroe Street ("Property"); and <br />WHEREAS, the Property is necessary for the Town to acquire for right-of-way as <br />part of the construction of the Project along Monroe Street, as set forth in more detail in <br />Exhibit B, attached hereto and incorporated herein by reference; and <br />WHEREAS, Indiana Code § 36-1-11-8 authorizes the transfer of property between <br />governmental entities and governmental agencies upon terms and conditions agreed <br />upon by the entities, as evidenced by the adoption of a substantially identical resolution <br />by each entity. <br />NOW, THEREFORE, BE IT RESOLVED, that the Town of Mooresville, by and <br />through its Town Council ("Town') hereby makes the following findings: <br />1. The foregoing Recitals are incorporated herein by this reference. <br />2. The transfer of the Property shall be by quitclaim deed and the Town and <br />the School shall execute all other usual and customary conveyance documents. The <br />Property shall be conveyed in consideration of the road improvement and for no <br />additional consideration. <br />
