MOORESVILLE TOWN COUNCIL RESOLUTION NO. 2 rO ®7 A RESOLUTION OF THE TOWN OF MOORESVILLE, INDIANA AND THE MOORESVILLE CONSOLODATED SCHOOL CORPORATION REGARDING AN INTRAGOVERNMENTAL TRANSFER OF REAL PROPERTY WHEREAS, the Town of Mooresville, Indiana (hereinafter, the "Town') is a political subdivision of the State of Indiana; and WHEREAS, the Mooresville Consolidated School Corporation is an agency of a political subdivision (hereinafter, the "School"); and WHEREAS, the Town desires to implement a road project along Monroe Street, Mooresville, Indiana ("Project"); and WHEREAS, the School is the fee simple owner of certain property more particularly described in a legal description set forth in Exhibit A, attached hereto and incorporated by reference, which property is located within the Town of Mooresville, Hendricks County, Indiana and is situate adjacent to Monroe Street ("Property"); and WHEREAS, the Property is necessary for the Town to acquire for right-of-way as part of the construction of the Project along Monroe Street, as set forth in more detail in Exhibit B, attached hereto and incorporated herein by reference; and WHEREAS, Indiana Code § 36-1-11-8 authorizes the transfer of property between governmental entities and governmental agencies upon terms and conditions agreed upon by the entities, as evidenced by the adoption of a substantially identical resolution by each entity. NOW, THEREFORE, BE IT RESOLVED, that the Town of Mooresville, by and through its Town Council ("Town') hereby makes the following findings: 1. The foregoing Recitals are incorporated herein by this reference. 2. The transfer of the Property shall be by quitclaim deed and the Town and the School shall execute all other usual and customary conveyance documents. The Property shall be conveyed in consideration of the road improvement and for no additional consideration.
