MOORESVILLE TOWN COUNCIL <br />ORDINANCE NO.: (�Y, ?g)23 <br />AN ORDINANCE AMENDING THE OFFICIAL ZONING MAP <br />OFTHE TOWN OF MOORESVILLE, INDIANA, REZONING THE <br />SUBJECT PROPERTY FROM SINGLE FAMILY RESIDENTIAL (R1) TO <br />MEDIUM -DENSITY RESIDENTIAL (R2) <br />WHEREAS, this rezoning was requested by Bryant E & Joni M Hopwood, dated <br />September 29,2023, being all owner of the subject property and giving consent; and <br />WHEREAS, the Town of Mooresville Plan Commission, pursuant to Indiana Code <br />37-7-4 did, on November 9,2023 hold a legally advertised public hearing on said request <br />and has certified a favorable recommendation to the Town Council of Town of <br />Mooresville: and <br />WHEREAS, the Mooresville Town Council, after diligent review of the matters <br />pertaining to rezoning of the above described land at a public hearing held on the 5'" day of <br />December, 2023 find that the requested zoning classification, with voluntary commitments, is <br />appropriate. <br />NOW THEREFORE BEIT ORDAINED bythe Town Council of the Town of <br />Mooresville, Indiana as follows: <br />SECTION 1: Official Zoning Map <br />Thezoning classification ofthe real estate as described in Exhibit 'A' which is within the <br />zoning jurisdiction of Town of Mooresville, Indiana, shall bechangedfrom Single Family <br />Residential (R1) to Medium -Density Residential (R2) <br />SECTION 2: Repealer <br />All ordinances or parts thereof in conflict with this ordinance shall be repealed to the extent of <br />such conflict. <br />SECTION 3: Severability <br />If any provision, or the application of any provision, of this ordinance is held unconstitutional or <br />invalid the remainder of the ordinance, or the application of such provision to other <br />circumstances, shall be unaffected. <br />SECTION 4: Effective Date <br />That this rezoning, shall be effective as of the execution of this Ordinance. <br />Dated: <br />Tom Warten <br />President -Mooresville Town Council <br />
