Couneil November 10, 1999 Recommendations for a change in the Subdivision Control Ordinance Drimarv aDDroval Drocess Dear Council Mcmber: Attached please find a copy of a letter submitted to the Moorcsville Planning Commission at their October 28 regular meeting, requesting eonsideration of some proposed changes in the subdivision primary plat approval process, While these recommendations were not submitted as testimony relative to a specific meeting agenda item, they have been developed based on the almost year long experience of multiple submissions ofa proposed subdivision development plat within the Mooresville buffer zone. The reasonable expeetations of the second paragraph of the attached letter suggest a fourth recommendation for consideration in the approval process. 4, It should be a clearly stated requirement of the Ordinance that the petitioner andlor his representatives are obligated to fully disclose, justifY, and request specific approval of. each and every deviation, discrepancy or non-compliant aspect of the proposed subdivision plat when presented at the primary approval publie hearing, ~ The above rccommcndatlOn places no unrcasonable burdens or expcnses on petitioners. it only requires full and complete disclosure and honesty, and prohibits misrepresentations, when submitting development proposals before the plan commission. the town council. and the public, It is the objective of these recommendations to ensure that the governing bodies of this communi tv (Mooresville Plan Commission and Tom!
