M. <br /> <br />The Mooresville Plan Commission met Thursday, April 22, 1999,7:00 P. M. at the Mooresville <br />Town Hall. <br /> <br />Plan Commission members present were: Joel Beebe, John McGuire, Mike Young, Alan <br />Marshall, Bill Abbott, and Andy Pygman. Commission members absent were: Vern Kimmel, <br />Tim Bennett, and John Ehrhart. Town Attorney Tim Currens was present. <br /> <br />First on the agenda, Dewayne O'Neal representing the developer of Morgans Hideaway on <br />Rooker Road presented a Preliminary Plat Approval of272 lots on 174 acres. 17.3 % of total <br />area to be used for common use. 16,000 square foot minimum lot and 1600 square foot <br />minimum home. Manufactured housing to be used in tIùs development. He said the rezone had <br />been previously approved by the Plan Commission and Town Council and that after the fact <br />traffic and overcrowding of the schools were considered by the Plan Commission and <br />surrounding landowners. He stated a contract was available with C & M for sanitary sewers. <br />Commissioner Pygman said he did not see how residents could vacate in the event of a field fire <br />with only one way in and one way out. <br /> <br />Frank Hogan, attorney for the surrounding landowners, showed a short video of existing sparse <br />'-.. development in that area and the rugged territory surrounding the proposed development. Mr. <br />Hogan stated the Burrell case, which Town Attorney Tim Currens was familiar, which says by <br />law this Plat does not have to be approved because conditions for health, safety, and welfare can <br />be imposed. Mr. Hogan introduced Brad Yarger, Purdue Engineering Graduate with 16 years of <br />experience and President of Yarger Engineering which is all Transportation Engineering. He <br />spoke to the Commission of a sight problem at the intersection of Rooker and Dayhuff to the <br />east. He said in the Sub Division Ordinance Item #1 - 50 to 60 foot jog at Rooker and Da <br />yhuffRoads. Item # 10 - five legged intersection. His concern is safety because of geometrics <br />and that one entrance is of much concern. He made the statement he would not put his stamp on <br />the project. Jim Patrick of I 101 DayhuffRd wanted the entrance road to be straightened out, <br />but Mr. Wolfe, owner of the property would not move the road. The road will wrap around the <br />Patrick property. Commissioner Abbott a'sked for legal clarification. Town Attorney Tim <br />Currens said the Commission had not had a case like tIùs in the past and told the Commission <br />they could have findings of fact on the access. <br /> <br />Kent Leuten, representative of Manufacturing Housing Association showed photos of actual <br />manufactured homes that would be in tIùs subdivision. They range trom 28 -32 feet wide and <br />60-80 feet in length. Commissioner Abbott had questions for Mr. Yarger such as distance of <br />road to cul-de-sacs and if the cul-de-sacs were adequate size. He said this was a concern of the <br />Tech Committee. Bob Turner spoke to the Commission about the levy. He said if it lets go the <br />whole subdivision is gone. He had created an emergency spillway but it could happen. He <br />__ wanted to ask the Andersons iffourteen of the lots could not be developed and be a buffer for <br />
