<br />'-- <br /> <br />MOORESVILLE PLAN COMMISSION <br />MINUTES <br />SEPTEMBER 24, 1998, 7:00 P.M. <br /> <br />The Mooresville Plan Commission met in regular session on Thursday, September 24, 1998, at <br />7:00 P. M. at the Mooresville Town Hall. <br /> <br />Commission members present were: President Joel Beebe, Secretary Vern Kimmel, Charles <br />McGuire, Mike Young, John Ehrhart, Tim Bennett, and Andy Pygman. Commissioner Campbell <br />and Commissioner Abbott was absent. Town Attorney Tim Currens was present. <br /> <br />Motion was made by Commissioner McGuire, second by Commissioner Ehrhart to approve the <br />minutes as corrected for the August 27,1998 meeting. Motion carried 7-0. <br /> <br />Ross Holloway of Holloway & Assoc. informed the Plan Commission the IDEM approval <br />permits for R. 1. & Assoc., Ashbury Park were not in yet and requested a continuance. <br />This was granted. <br /> <br />A continuance was requested and granted for Charles Robert's property on Highway #144 <br />because it would be at least thirty days before the matter was cleared up concerning the death of <br />the owner of the property. <br /> <br />'-- Ross Holloway presented the Charles O'Neal request for a 2 lot minor plat and rezone for Lot 2 <br />from R-I to B-1 for 267 East Main Street. The BZA had granted a variance from Development <br />Standards for B-1 use at the August meeting. Commissioner McGuire voiced concern over the <br />two small size lots and stated he was against rezoning residential areas for business. Motion was <br />made by Commissioner Kimmel, second by Commissioner Ehrhart to grant the Minor Plat <br />subject to obtaining a variance for Lot #1 width. Motion was neither passed or rejected because <br />5 votes were needed and the vote was 3 for the motion and 4 opposed. Those Commissioners <br />opposed were Mike Young, Charles McGuire, Tim Bennett, and Andy Pygman. Ross Holloway <br />requested the minutes reflect why they were opposed. The concensus was: the lot sizes. <br /> <br />The Commission requested Attorney Tim Currens to send a letter to 545 North Indiana Street <br />(operating a business in the home) to cease and desist. They also requested a letter be sent to <br />the residents on Indianapolis Road for operating a shop in their home to cease and desist. <br /> <br />Building Inspector Joe Beikman reported thirty two (32) permits and one hundred two (102) <br />inspections. <br /> <br />President Beebe signed Certifications of Actions taken at the August meeting of the Plan <br />Commission. Findings ofFact-denied Remster Minor Plat due to the layout of potential houses <br />not consistent- house facing the back of another house. Finding of Fact-denied O'Neal Minor <br />Plat-Both lot sizes and the width of Lot # I. <br /> <br />'-' <br />
