<br />"' <br /> <br />,-. <br /> <br />MOORESVILLE PLAN COMMISSION MINUTES <br />THURSDAY, JUNE 25, 1998, 7:00 P. M. <br /> <br />The Mooresville Plan Commission met in regular session on Thursday, June 25, 1998, at 7:00 P. <br />M. at the Mooresville Town Hall. <br /> <br />Commission members present were: President Joel Beebe, Vern Kimmel, Mike Young, John <br />Ehrhart, Steve Campbell, Bill Abbott, Charles McGuire, Tim Bennett, and Andy Pygman. No <br />members were absent. <br /> <br />Jim Remster Minor Plat was tabled to the next meeting in July. <br /> <br />The James 2 Lot Minor Plat was presented by Larry Cramer of Lewis Engineering. This property <br />is located on Indianapolis Road. The Mooresville Park District is buying 4.38 acres which is Lot <br />#2. Lot # I is 6.2 acres and has a home and outbuildings located on it. A motion was made by <br />Commissioner Abbott, second by Commissioner Kimmel to approve the James 2 Lot Minor Plat <br />with exception of waiving depth to width ratio. Motion carried 9-0. <br /> <br />,-. <br /> <br />Attorney Mark Peden represented Attorney Susan Neeley for a rezone of property located at <br />3081 State Road 144 from Agriculture to B-1. She had bought the property before it was <br />included in Mooresville's Buffer Zone. Several residents spoke against more Business in the <br />area; Sue Hall, Charles Shue, and others. After much discussion, a motion was made by <br />Commissioner Abbott, second by Commissioner Bennett to recommend to the Town Council to <br />rezone this property from Agriculture to B-1. Motion carried 7-2. Commissioners Pygman and <br />McGuire opposed. The Commission informed Ms. Neeley she would have to comply with <br />Mooresville's sign ordinance or file for a variance. This rezone will go to the Town Council at <br />their July 7, 1998 meeting. <br /> <br />"----- <br /> <br />Holloway & Assoc. presented the Fritch-Charles Roberts Minor Plat at 3076 St. Road 144, <br />location of the existing garden shop. This property is two separate parcels side by side. After <br />some discussion, a motion was made by Commissioner Abbott, second by Commissioner <br />Campbell to approve the Minor Plat subject to a variance for Lot #3 because it does not meet the <br />square foot requirements, obtaining septic pennits, length to depth ratio, and showing the <br />building lines on the plat. Motion carried 7-2. Commissioners McGuire and Bennett opposed. <br />The rezone for this same property from Agriculture to B-3 had been tabled to this meeting. Dale <br />Coffey, an attorney for the nearby residents, presented a petition of 63 signatures opposed to the <br />rezone. Residents speaking in opposition were: Mrs. Hall, Charles Shue, Mrs Haney, James <br />Torrence, and Gary Tapp. Mr. Holloway said the client would voluntarily change the petition to <br />a B-2. Motion was made by Commissioner McGuire asking for a moritorium put on any <br />rezoning in this area until a comprehensive plan was drawn up. No second to the motion was <br />forthcoming. Motion died. Commissioners Campbell and Abbott were in favor of tabling to the <br />next meeting. <br />Motion was made by Commissioner McGuire, second by Commissioner Ehrhart to recommend <br />to the Town Council this rezone petition be denied. Motion carried 6-3. Commissioners Abbott, <br />Beebe, and Campbell opposed, This rezone will be heard at the July 7th Town Council meeting. <br />
