M.

The MooresviIle Plan Commission met in regular session on Thursday, May 22, 1997 at 7:00 P.
M. at the MooresviIle Town Hall.

Members present were: Commissioners Vern Kimmel, Mike Young, Bill Abbott, Charles
McGuire, John Ehrhart, and Steve Campbell. Tim Bennett and Joel Beebe were absent.

Motion was made by John Ehrhart, second by Steve Campbell to approve the minutes of the April
27, 1997 meeting. Motion canied 6-0.

Ross Holloway of Holloway and Associates presented the Wolfe Rezone ftom Agriculture to RIA,
which is low density residential. The entrance would be at the comer of Rooker Road and
Dayhuff Road. Several residents of the area spoke against the rezoning because of the overload of
traffic on Rooker Road. Homeowner Bob Turner stated he felt Mr. Wolfe would work with the
neighbors on buffering zones between the properties. This request for a rezone meets the
comprehensive plan.

Motion was made by Commissioner Abbott ,second by Commissioner Eluhart to recommend to
the MooresviIle Town Council to rezone this property from Agriculture to RIA. Motion canied
6-0.

Before the Commission next was the Swango 4 lot minor plat. This property is located off of
Crosby Road, east of Bethel Road. This plat is subject to a variance for setback on Lot 1 for a
building line. The commission was presented with soil and Board of Health reports, green cards
and the legal notice. Mr. Culver, a next door neighbor was interested in the size of the homes
since the Agriculture zoning still exists and the minimum house size is 1100 square feet. Mrs.
Swango answered by stating this was for family use and the house was to be 2000-2200 square
feet for themselves on Lot #2. Motion was made by Commissioner Campbell, second by
Commissioner Young to approve the 4 lot minor plat subject to # 1 and # 8 on the Tech
Committee report. # 1 is a need for the location of existing finger system on Lot # 1 and #8 is to
check for possible easement through center of Lot #4 (water line supposedly runs through the lot),
also, possible gas line. Motion canied 6-0.

'-...-

TheAmerican Baptist Church had a request for a special exception to Agriculture zoning for
School purposes. This church is the former site of the Baptist Church located on State Highway
#144 one mile east of Highway 67. Grades 4 thru 9 will move there next year. Motion was made
by Commissioner Abbott, second by Commissioner Young to forward a proposal to the
Mooresville Board of Zoning Appeals that this special exception is not adverse to the
Comprehensive Plan. Motion canied 6-0.

Building Inspector Joe Beikman reported twenty-one (21) pennits and fifty-three (53)
