<br />.' <br /> <br />MOORESVILLE PLAN COMMISSION <br />MINUTES <br />THURSDAY, APRIL 26, 2001 <br /> <br />The Mooresville Plan Commission met on Thursday, April 26, 2001, at 7:00 P.M. at the <br />Mooresville Town HalL <br /> <br />Commission members present were Joel Beebe, Chairman, Jim Bruner, Andy Pygman, <br />Robert Williamson, Robert Corbin, John Ehrhart, Chris Crouch, and Mike Young. Tim <br />Bennett was absent. Town Attorney, Tim Currens was also present. <br /> <br />Motion to approve the minutes for the March 22, 2001 was made by Commissioner <br />Pygman, and second by Commissioner Ehrhart. Motion carried 8-0. <br /> <br />First order of business was Mr. Kuhns, County Line Road; he was reported to be running <br />a scrap metal business from his home. Mr. Kuhns stated he only stored the scrap metal <br />until the price went up and he could take it in to sell at the scrap yard. He stated he was <br />storing the scrap metal before his property was in the Town buffer zone. He had cbecked <br />with the county officials and that be was in compliance with the county code. He started <br />storing metal inside the sbed on the back of property in 1988 and in 1993 be started <br />storing metal outside the shed. Five years ago be started a courier business, whicb only <br />consist of the van. Mr. Currens will check into the county ordinance and report bis <br />findings to the Commission. This was tabled until next meeting. <br /> <br />Next was a petition on bebalf of Casey's General Store for Cloverleaf Properties for <br />rezone from B-2 to B-3 on property located at State Road 144 and Springmill Drive. Mr. <br />Bill Barrett, representing Casey's General Store, stated they were asking for the rezone <br />because B-2 zoning did not allow for storage and sale of gasoline. The store will be <br />identical to their store at Bridge Street and Indianapolis Road. The store will set at least <br />100 feet from apartment to the back. They will put up a fence if additional buffer is <br />needed. The concern of tbe Board was the traffic congestion in the area. He was asked if <br />the site bad been approved by the state and he replied that it bad. There will be an <br />.entrance into the site off of State Road 144 and also one off of Springmill Drive. Mr. <br />Ross Holloway, 652 Vista View, asked that the board deny the B-3 zoning on the <br />grounds that it is not in character of the area. Mr. Holoway asked if they could apply for <br />a Special Exception. He was told there is no provision under B-2 for a Special <br />Exception. <br /> <br />Motion to recommend to the Town Council to deny petition for rezone from B-2 to B-3 <br />was made by Commissioner Pygrnan, second by Commissioner Ehrhart. Motion carried <br />4-4. There not being a majority petition was tabled until next meeting May 24, 2001. <br /> <br />Next Mr. Ross Holloway, of Holloway and Associates, representing Phyllis Montague, <br />presented a petition for a two lot minor plat located two miles east of State Road 67 on <br />State Road 144. There is an existing 40-foot access and utility easement to the property. <br />
