<br />MOORESVILLE PLAN COMMISSION <br />MINUlES <br />THURSDAY, JANUARY 23, 2003, 6:00 PM <br /> <br />The Mooresville Plan Commission met in regular session on Thursday, January 23, 2003, <br />at 6:00 PM at the Mooresville Town Hall. <br /> <br />Commission members present were: Chairman Mike Young, Chris Crouch, Troy Bryant, <br />Tim Bennett, Robert Williamson, Robert Corbin, John Ehrhart, and Charles Mc Guire. <br />Commission member Jim Bruner was absent. Town attorney Tim Currens was present. <br /> <br />Attorney Tim Currens reminded the commission that at the last meeting they voted to use <br />paper ballots for voting and that would begin with this meeting. <br /> <br />Chairman Mike Young introduced Troy Bryant as the new member on the commission. <br /> <br />Reorganization: Motion was made by Commissioner Ehrhart to nominate Mike Young <br />for Chairman for 2003, second by Commissioner Bennett. Motion carried 7-0. <br /> <br />Motion was made by Commissioner Ehrhart to nominate Charles McGuire for vice- <br />chairman, second by Commissioner Bennett. Motion carried 7-0. <br /> <br />Motion was made by Commissioner Crouch, second by Commissioner Bennett to <br />nominate John Ehrhart for Secretary. Motion carried 7-0. <br /> <br />A request for a rezone from R-I to R-3 at 103 West High Street by Linda Asher was <br />heard first. The garage already had an apartment upstairs and they were making an <br />apartment downstairs. There would be one two bedroom down and one two bedroom <br />upstairs. The question by the commission was the parking. The Ashers said they could <br />pull cars up in the driveway and still get a car passed them. Commissioner Williamson <br />told them he didn't think there was enough room. The contractor for the Ashers told the <br />commission the driveway goes down over the hill in the back yard at the south end of the <br />garage. Commissioner McGuire asked if they had gotten a building permit and the <br />contractor said he didn't because he only took out the garage doors and put in a wall. <br />Commissioner Bryant said the parking area had to be paved or a dust free surface with <br />eight or nine packing spaces at a size of 9x20 each. Town attorney Tim Currens had told <br />them they had two choices, a variance or a rezone. Commissioner McGuire said there <br />was no way for a re-zone on this property because it was not legal. Motion was made by <br />Commissioner Williarnson, second by Commissioner Bryant to recommend to the Town <br />Council to deny this rezone from R-I to R-3. Vote by paper ballot was 7-1. Motion <br />carried. <br /> <br />Next on the agenda was Jeff Banning for Arbor Homes with a request for re-zone for the <br />Jessup property on Hadley Road from Agriculture to RIC and RID. Chairman Mike <br />Young expressed his concern that he thought a one year wait was required before are-file <br />
