MOORESVILLE PLAN COMMISSION
MINUTES
THURSDAY, MARCH 24, 2005, 6:00 P.M.

The Mooresville Plan Commission met on Thursday, March 24, 2005, at 6:00 P.M. at the
Mooresville Town Hall.

Commission members present were: Chairman, Mike Young, Darrell Brown, Robert
Corbin, John Ehrhart, Jim Logan, Charles Berwick and Troy Bryant. Town Attorney,
Tim Currens was present.

A motion was made by Commissioner Ehrhart, second by Commissioner Corbin, to
approve the minutes of the February 24, 2005 meeting. Motion carried 6-0.

The first item on the agenda was Holloway Engineering, representing Robert & Mary
Bingham, seeking a rezone at 114 E. High Street. The original petition stated that the
rezone was from B-1 to I-I, however, Mr. Holloway stated that the property is actually
zoned R-l at present and after some in-depth discussion with Mr. Bingham they have
decided that they would like to amend the petition to ask for a rezone to B-2 instead ofI-
1. The areas to the east of the lot have extensive 1-2 zoning, with I-I zoning across the
street and around the railroad. There is a B-1 use at the lot directly to the west of this lot.
Mr. Holloway stated that it doesn't make any sense to have a residential zoning between
a B-1 and 1-2. Mr. Bingham is proposing building a 4800 square feet building with a
couple retail businesses in front and some personal storage and storage for the businesses
in the back. Mr. and Mrs. Walls of 81 Sunbury Drive, who own a rental home next to the
lot were present and wanted to know what Mr. Bingham had planned for the property and
how close to the property line it would be. They wanted to know ifhe was putting
another carwash on that lot. Mr. Bingham stated that they haven't designed the building
yet but the requirement is that the building be at least ten feet off the property line. He
also stated that the carwash would go on the lot that is currently the Speedway Auto Parts
store. They were also concerned with the increase in traffic because there are young
children living in their rental home. Ross Holloway stated that although the traffic will
increase some since the property is currently a residence, it will certainly be less with a
retail shop there than it would be if it were a carwash.

A motion to favorably recommend to the Town Council the rezone of 114 E. High Street
from R-l to B-2 was made by Commissioner Brown, second by Commissioner Logan.
Motion carried 6-0. Commissioner Bryant arrived after the vote was taken.

The next item on the agenda was the Field Site Ordinance. Attorney, Tim Currens said
that we are still waiting on a comment from the County, so there was no discussion.

In other business, Commissioner Ehrhart told the Commission that he had recently been
contacted by a resident of Heartland Crossing concerning a home being built in the
Hanson and Horn area that does not have any masonry. Attorney, Tim Currens asked
Building Inspector, Joe Beikman to address the issue because he knew Joe had looked at
