FINDINGS OF FACT <br /> <br />Comes now Janice Smith and James Smith, the owner of the real <br /> <br />property known as 9010 Raccoon Run Road, Mooresville, Indiana, <br /> <br />containing 3.638 acres and pursuant to her petition requesting the <br /> <br />use of a 70' X 20' shed for use as produce stand on their property <br /> <br />which is zoned agriculture and the Board having made certain <br /> <br />findings of fact pursuant to Indiana Code 36-7-4-918.4 as <br /> <br />follows: <br /> <br />1. That the approval of said variance would not be injurious <br />to the public health, safety, morals, and general welfare of <br />the community in that there is a bookshop on the adjoining <br />property and that this is compatible with an agricultural <br />zoning. <br /> <br />2. The use and value of the area adjacent to the property <br />included in the variance would not be affected in a <br />substantially adverse manner due to other commercial uses and <br />the similar use being requested being an agricultural use. <br /> <br />3. That the need for the variance arises from some condition <br />peculiar to the property involved in that it is too small to <br />use for any other agricultural use and this is consistent <br />with the outbuildings already on said property. <br /> <br />4. That the strict application of the terms of the zoning <br />ordinance would consitute unneccessary hardship if applied <br />the property which the variance is sought in that the <br />property is not sufficiently large for other agricultural <br />uses. <br /> <br />to <br /> <br />5. That the approval does not interfere substantially with <br />the comprehensive plan adopted under this chapter in that it <br />is a consistent use with the agricultural uses surrounding. <br /> <br /> <br />
