FINDINGS OF FACT <br /> <br /> Comes now Shirley J. Moore, and having filed her request for <br />variance from the development standards of the Civil Town of <br />Mooresville consisting of the required width to depth ratio on <br />lots in subdivisions for proposed Tract #4 in the Minor Plat of <br />Shirley J. Moore which is 150' x 663'; said tract being located <br />off of Bunker Hill and Overpeck Roads in Mooresville, Indiana, <br />more particularly described in the attached Exhibit "A" which is <br />attached hereto and made a part hereof; and the Board now makes <br />the following findings of fact pursuant to I.C. 36-7-4-918.5: <br /> <br /> 1. That the approval would not be injurious to the public <br /> health, safety, morals and general welfare of the community <br /> in that this lot size and location in the country should have <br /> no adverse effect. <br /> <br /> 2. That the use and value of the area adjacent to the <br /> property included in the variance will not be affected in a <br /> substantially adverse manner and in effect would be adversely <br /> affected if said property were broken down into more than one <br /> lot. <br /> <br /> 3. That the strict application of the terms of the zoning <br /> ordinance would result in practical difficulties in the use <br /> of this property due to the geography of said terrain, making <br /> it inappropriate to subdivide it in any other manner. <br /> <br /> The Mooresville Board of Zoning Appeals now grants the <br /> variance from the width to depth lot ratio on Tract #4 of Shirley <br /> J.
