Tliei•e were several residents of Sundown Manor present to remonstrate. They had <br />concerns about the plans to build a commercial building on the property. The adjoining <br />property owners felt that because they were told that they could acquire the property by <br />adverse possession since they had been maintaining it for several years, that zzo one else <br />could acquire the property. Tim Currens explained that even though they had the option <br />of acquiring it by adverse possession, it did not mean that no one else could and that their <br />issues were civil issues and not the issues of the Town, which was the purpose for this <br />meeting. <br />Vernon Austermiller of 323 Sundown Manor stated that the town might need the <br />roadway easement at some time because the road might need to be widened or moved. <br />He stated that southbound semis on SR G7 cannot make the turn onto Old SR 67 without <br />knocking down the stop sign or going into the ditch. Ross Holloway stated that there is <br />considerable green space between the highway and the property for widening purposes <br />and they would be more than willing to give a 35' utility easement on the east side and an <br />8' strip on the west side: <br />Sieve Overton, who owns a business on Old SR 67 stated that he thinks it won't be long <br />before something will have to be done with the road due to increased traffic on SR 67 and <br />the number of accidents that happen there. Councilman Harris stated. that he believes <br />there znay come a time when the Town needs that roadway easement, even. if it is twenty <br />years iu the future. Ross Holloway stated that when lie met with the people from INDO7" <br />before they released it back to the county, they had no problem. with it being released and <br />were willing to do that, but the owner at the time did not follow through. Ross stated that <br />if it was going to be an issue, lie could provide additional documentation that would <br />prove that the property would not be used for a roadway and they would ask for a <br />continuance to provide that information. <br />A motion to deny the request for a continuance was made by Councilman Harris, second <br />by Councilman. Doles. Motion carried 3-1. Councilman Clark opposed. <br />A motion to deny the request for the vacation of the right-of way was made by <br />Councilman Harris, second by Councilman Doles. Councilman <br />Clark opposed. <br />The next item on the agenda was Kim and '1°ina Dyer of 740 Johnson Road, requesting <br />permission to book on to the sanitary sewer, tabled from the May 1$th meeting. Mr. Dyer <br />asked for clarification of the cost of hooking on. President Warthen stated that since it is <br />an existing house, tl~e hook on fee would be $900.00. He told Mr. Dyer to get with Joe <br />Beiknaarr to discuss elevations. He also asked. the Dyers to submit a letter requesting <br />annexation into town. 'I.~rey asked if their tax rate would change and he said. it would <br />change from the Brown Township rate to the Town of Mooresville rate. Tlae llyers <br />stated they agreed to the hook on fee and to be annexed into town. <br />A motion was made by Councilman Clark, second by Councilman Doles, to approve the <br />request of Kim and "Tina Dyer to hook on to the sanitary sewer. Motion carried 4-0. <br />The next item was the awarding of the bids far a new fire truck. President Warthen stated <br />that hire Chief, Les Farmer has a list of items of which the lowest bid truck did not meet <br />the criteria from the bid sheet. President Warthen had spoken to a gentleman froze that <br />manufacturer who said he could make the necessary changes on the quote and he asked <br />Attorney, Tirn Currens if they could allow them to make changes to clarify the <br />specifications. Tim Currens stated. that if the bid was being changed, he would have to <br />look at the specific items being changed to determine if it would be allowable. He stated <br />that their options would be to continue it to allow him time to do that, deny all the bids <br />and rebid, or accept a given bid, however the whole idea of the bid process is that <br />everyone is on equal. grouzzd the night the bids are opened. <br />Councilman Harris asked which bid did. not meet the specifrcations. Les Fanner stated <br />that it was ilae bid from KME. Councilman Harris stated t11at he was not happy that KME <br />wanted to make changes after the bids were in and that it would not be fair to the other <br />bidders. <br />Councilman Harris made a motion to accept the higher bid from Pierce because it did <br />meet the specifications, and the lowest bid did not. Motion was second by Councilman <br />Doles and carried 3-l. President Warthen apposed. <br />Under Legal Counsel, Attorney, 'I"im Currens presented the Council with a Deed of <br />Dedication for a road in Mooresville Town Center, section 4 from Mooresville Partners. <br />
