In the legal department, Tirn Currens had the Council to sign the reitrrld agreement for <br />Dodd's Property, which they lxad previously approved. He also asked the Council to set a <br />date to review the Comprehensive Plan. It was set for January 6~'. <br />Dan Hilton frotrt. Indiana American Water Company was present to discuss an agreement <br />between the Town and. Indiana American concerning the Town's hook-on at the <br />MethodisC Church Building. I-lowever, Tim Cur~ens did riot have a copy of tl~e letter <br />_.. <br />from Dan Hilton so there was no discussion. Dan Hilton will fax a cagy of the letter to <br />Tiro Currens and he will put an agreement .into written form. <br />Corrtrcilman Bryant. asked Titxr Curretrs about his review of the case of Mrs. Tliompsort <br />on North Iiadiana who thought she was hooked onto the salutary sewer. arld was not. Tim <br />Currens stated that sae had sent a letter to Mrs. 7'hompson's Counsel. and was in need of <br />more information to properly assess what she is requesting. <br />Councilman Warthen reported on behalf of the Fire Department that the rescue unit was <br />back and had beers addressed by Meritor and the le<<tk in the rear end has been repaired. <br />Joe Beiktnan asked the Council. to approve the availability agreement for Flag I in <br />Flagstaff Business Park. Councilman Wat~l~en asked Tim Currens if there was a way to <br />stipulate the occupancy for the availability :fee since it is a spec building. T.irn Currens <br />said what was generally done is the fee is set up by the initial occupancy and if the use <br />changes it would be dcter~rnined if more fees are owed at that time. He stated that it <br />needed to be put into written. faun so that if a company were platrtring to buy the building <br />they would know that there was a potential liability for additional fees. Councilman <br />Warthen then made a tnolion, second by Councilman Bryant to approve the availability <br />fees with notice served that the fees could change with occupancy. Motion carried 4-0. <br />Atlirnal Control Officer, :Mark Taylor reported 19 (ni.neteen) calls, 9 (nine) impounds and <br />no returns. <br />Corrncilrnan Bryant asked to address what was previously discussed earlier this surTnner <br />regarding Gary Fields from the Young Addition wanting to buJld a house on Marcia <br />Drive between Karrington Estates and the new condominiums on .Hadley Road. The <br />'Town had told. Mr. Fields that they would send out letters to the residents in that <br />neighborhood to find out what percentage would be willing to be annexed and hook onto <br />the sewer. 'That has not been done at this time. Councilman Bryant asked for a list of <br />residents in that neighborhood so the ]ewers could be sent- He sr<zted that Joe Beikman <br />had indicated that Econotxric Development used to lake care of those things but with. their <br />new responsibilities to the County they would no Inrrger handle that. Councilman Bryant <br />asked Joe if he or Peggy would be able to go to the County and get the list within the next <br />couple of weeks? Joe stated that they were too busy with Rule 13 and could not do t1raC <br />in the next couple of weeks. 'l'int Cunens said. that he would do it the next time he was at <br />the courthouse. <br />Motion was made by Councilman Wartl~en, second. by Councilman Clark to approve <br />payment of the claims.
