A <br /> ccolpr <br /> MOORESVILLE BOARD OF ZONING APPEALS <br /> FINDINGS OF FACT <br /> SPECIAL EXCEPTION <br /> The Mooresville Board of Zoning Appeals having heard the <br /> special exception to allow the use of an automobile sales <br /> business in a B-3 zoning area now finds the following: <br /> 1 . The establishment, maintenance or operation of this <br /> special exception will not be detrimental or endanger the public <br /> health, safety, morals or general welfare of the community with <br /> this use being compatible with the surrounding area. <br /> 2 . The special exception will not be injurious to the use <br /> and enjoyment of other properties in the immediate vicinity for <br /> the purposes already permitted in that there are other similar <br /> uses and the area is clearly commercial . <br /> 3 . The establishment of the special exception will not <br /> impede or substantially alter the normal and orderly development <br /> and improvement of the surrounding property for uses permitted in <br /> the district with the area already being business and developed. <br /> 4 . Adequate utilities, access roads, drainage and other <br /> necessary facilities are currently existing. <br /> • 5. Adequate measures exist to provide ingress and egress to <br /> minimize traffic congestion on the public roads with the <br /> restrictions set out herein. <br /> 6. This special exception will be located in a district <br /> where such use is permitted and all other requirements in this <br /> Ordinance which are applicable to such special exception will be <br /> met. <br /> 7 . The Board further finds that pursuant to agreement of <br /> the Applicant the use will be limited to eight (8) vehicles at <br /> any one time being displayed for sale. <br /> 8 .
