MOORESVILLE BOARD OF ZONING APPEALS <br /> FINDINGS OF FACT <br /> SPECIAL EXCEPTION <br /> A Special Exception request was filed by Mr. Wayne Pace of <br /> 269 N. Monroe St . , Mooresville, Indiana the 8th day of August, <br /> 2002 . Mr. Pace had requested a Special Exception for the use of <br /> mini warehouses in a B-2 (local business) zoning classification. <br /> The Mooresville Plan Commission had made a previous Finding that <br /> the location and character of the Special Exception would not <br /> affect the Master Land Use Plan. <br /> The Board having heard evidence makes the following <br /> Findings : <br /> 1 . The establishment, maintenance or operation of this <br /> Special Exception would be detrimental to and endanger the public <br /> health, safety, morals and general welfare of the community due <br /> to the location of the Special Exception adjoining Residential <br /> Uses including an apartment complex and single family dwelling <br /> which are not compatible with this use. <br /> 2 . The Special Exception would be injurious to the use and <br /> enjoyment of other properties in the immediate vicinity of the <br /> Residential Uses already permitted due to the traffic and <br /> existing access which is also shared with residential users . <br /> There are small children in the area and limitations on the <br /> access that make it unsafe. <br /> 3 . The establishment of the Special Exception will not <br /> impede or substantially alter the normal and orderly development <br /> and improvement of the surrounding property for uses permitted in <br /> the district . <br /> 4 . There are adequate utilities, there is some question as <br /> to the access road which also serves a Residential Use. <br /> 5 . Adequate measures as proposed still left issues as to <br /> ingress and egress design as to the width of the ingress and <br /> egress but there is no problem as to traffic congestion on the <br /> public road. <br /> 6. This Special Exception of a warehouse is allowed in a B-- <br /> 2 zoning. <br /> Based upon the above Findings, the Mooresville Board of <br /> Zoning Appeals denies the requested Special Exception this 8th <br /> day of August, 2002 . <br />
