MOORESVILLE BOARD OF ZONING APPEALS <br /> THURSDAY, DECEMBER 16, 20047 6:00 P.M. <br /> MINUTES <br /> The Mooresville Board of Zoning Appeals met on Thursday, December 16, 2004, at 6:00 P.M. at <br /> the Mooresville Town Hall. <br /> Board members present were: Christopher Crouch, Mike Young, Don Barry and Jon Swisher. <br /> Chairman, Alan Kramer was absent. Town Attorney Tim Currens was present. <br /> A motion was made by Don Barry, second by Jon Swisher, to approve the minutes of November <br /> 18, 2004 meeting. Motion carried 4-0. <br /> First on the agenda was Tony Langley representing the Orchard Country Store requesting a <br /> variance of set back for sign. He would like to set the sign closer to road than the ordinance <br /> allows. The present sign for Gregory Orchard is presently in INDOT's right-of-way and what <br /> they would like to do is construct a sign for the Orchard Country Store and Gregory Orchard. <br /> To meet the ordinance guidelines the sign would have to be sixty feet from the edge of the <br /> pavement and would be in the middle of their parking lot. So they are requesting for the sign to <br /> be five feet from the right-of-way line, which would be thirty-five feet from the edge of the <br /> pavement, and placed between the two businesses. <br /> After reading the Fact-of-Finding for a variance from Development Standards a motion was <br /> made by Jon Swisher, second by Mike Young, to approve the variance from development <br /> standard for the sign to be five feet from right-of-way and thirty five feet from pavement. <br /> Motion carried 4-0. <br /> Next was Steven Litz, representing Donald Fischer, DDS, 118 N. Indiana Street, requesting a <br /> variance for additional parking. Two months ago they had the area rezoned to B-1 and they are <br /> requesting a variance to tear down the existing house to be able to add additional parking for his <br /> dental office. Now the patients use the same drive to enter and exit the parking lot, with the <br /> additional space they will have two entrances. They will then be able to have one-way entrance <br /> and exit and add approximately ten parking spaces. They will enter turning west and leave <br /> going east and the green space will stay about the same as it is now. The paved area will be <br /> approximately where the existing house is now. They need a variance for the side setback on <br /> the south side. Mr. Currens asked if Mr. Litz knew the exact dimensions of the variance he is <br /> requesting. He said they were on the diagram they had prepared. Mr. Young asked if they <br /> would be adding thirteen spaces and Mr. Litz said they would be squaring off some areas and <br /> there would be about ten new spaces. <br /> After reading the Facts-of-finding for a variance from developmental standards a motion was <br /> made by Don Barry, second by Jon Swisher to approve the variance for the side setbacks on the <br /> south side of property at 118 N. Indiana St. Motion carried 4-0. <br /> Next was Ross Holloway, Holloway Engineering, representing C C Patton, 315 Bolton Ave. <br /> requesting a variance of use that was tabled at the November 18, 2004 meeting.
