MOORESVILLE BOARD OF ZONING APPEALS <br /> THURSDAY, APRIL 149 2005 <br /> MINUTES <br /> The Mooresville Board of Zoning Appeals met on Thursday, April 14, 2005 at 7:00 P.M. <br /> at the Mooresville Town Hall. <br /> Members present were: Jon Swisher, President, Mike Young, Don Barry, and Charles <br /> McGuire. Alan Kramer was absent. Tim Currens, Town Attorney, was present. <br /> Motion to approve the minutes for the March 10, 2005 meeting was made by Don Barry, <br /> second by Mike Young. Motion carried 4-0. <br /> Next on the agenda was Hoosier Energy requesting a Special Exception for a substation <br /> at 497 E Bunker Hill Road. Mr. Aaron Wining sent a letter requesting a continuance <br /> until the May 12, 2005 meeting. <br /> Motion was made to grant the continuance for Hoosier Energy until the May 12, 2005 <br /> meeting was made by Charles McGuire, second by Don Barry. Motion carried 4-0. <br /> Next was Brenda Rose,requesting a variance of use to operate a Floral/Cake Shov at 69 <br /> E. Harrison Street. Ms. Rose stated this would not be a retail shop,but an out of home <br /> work shop. Mr. Young asked if they would be baking cakes and making floral <br /> arrangements and she said that was correct. Customer would only pick up cakes or floral <br /> arrangements. Mr. Young said there was very little parking and Ms. Rose said there <br /> were six parking spaces. Mr. Young asked if there were two apartments and she said <br /> that was correct. Mr. Swisher asked if they would be using only one apartment and she <br /> said that was correct and they would rent out the other apartment. Mr. McGuire asked if <br /> they needed permit from the Board of Health to operate a cake shop and she said they <br /> did. Mr. McGuire asked if there would be large delivery trucks to deliver flowers and <br /> supplies and she said she buys the flowers and supplies and picks them up herself. Mr. <br /> McGuire stated he hates to see businesses going into residential neighborhoods they keep <br /> reaching out farther into the residential area. Mr. Young asked if she was categorized as <br /> not a retail business and she said that was correct it would be more of a home occupancy <br /> shop. Mr. McGuire asked how people would know they were in business there and she <br /> said they would have business cards. Mr. Young asked if they would have a sign and <br /> she said they did not have to have a sign. The board said if there was a sign she would <br /> have to meet the requirement for the sign ordinance. Mr. McGuire asked if this was an <br /> upstairs and downstairs apartments and she said they were. Mr. Currens asked who owns <br /> the property and Mr. Brown stated he was the executor of the estate of Jerry Leon <br /> Edwards, which he is selling. The sale of the property depends on the variance going <br /> thru and she understands that the variance only applies to her. <br /> After reading the Facts-of-Findings a motion to grant the variance of use for property <br /> • located at 69 E. Harrison St. to operate a Floral/Cake Shop,based that there be no <br /> signage and no retail operation, was made by Don Barry. There being no second the <br /> motion died. Motion to deny the variance of use to operate for a Floral/Cake Shop at 69 <br /> E. Harrison St,based on this would interfere with Comprehensive Plan, was made by <br />
