Commissioner Ehrhart asked about the drainage down the road Mr. Holloway said that <br /> this would be addressed with the County. Commissioner Bryant asked about the <br /> covenants and restrictions being a 25 year existence. Mr. Holloway said that this would <br /> be change because the maintenance must go on after 25 years. Street Commissioner Joe <br /> Beikman asked if the street name had been checked for 911. Mr. Holloway said that <br /> There was no other road by that name. With no other questions Chairman Young ask for <br /> a motion on this matter. <br /> A motion by Commissioner Bryant to approve the preliminary plat with the stipulation <br /> that permits received from Morgan County Highway and Drainage approval, second by <br /> Commissioner Berwick. Motion carried 9-0 <br /> The next item Stephanie Bums 2-lot minor plat 4663 E. Shady Lane, continued from <br /> July. Mark Mahan,representing Burns explained that this plat is requested to build a new <br /> home, then sell the existing home. The set back changes have been made from the July <br /> Meeting. The property is a 9.2 acre lot off Shady Lane, West of Pennington.Road. <br /> Septic easements have been provided. The drive will be off of the existing drive the <br /> Highway Dept. will be contacted although the 25 foot asphalt drive is being used. <br /> Commissioner Bryant asked if the drive was going to next to barn, Mr. Mahan confirmed <br /> this to be correct. Commissioner Williamson asked about the pond being on both lots. <br /> Mr. Mahan said that the pond will be on lot 2. Street Commissioner Joe Beikman asked <br /> About pond drainage. A motion by Commissioner Bryant to table this matter until the <br /> next meeting to have the check list reviewed by the Tech review board, second <br /> • Commissioner Brown. Motion carried 8-1 with Commissioner Ehrhart voting no. <br /> The fourth item on the agenda Ross Holloway for Steve Striebeck asking for Rezone <br /> from Res. To PUD-E on.North Indiana Street,this also was continued from July. The <br /> issue of notifications has been corrected. Plans have been revised to almost 70 feet <br /> building to building, 68 parking spaces for the residential and 11 for the commercial <br /> Buildings. Also the green space has been increased and a park added along with <br /> sidewalks. Commissioner Bryant expressed concerns with having several owners. <br /> Mr. Holloway said that they would be governed by restrictions and covenants. <br /> Commissioner Ehrhart also expressed concern about out of state owners being a <br /> maintenance problem. Commissioner Browns concern with multiple owners is that it <br /> is sometimes becomes difficult to locate owners with high turn over. Commissioner <br /> McGuire spoke of a concern that other people may use the parking area for truck or <br /> motor home parking. Mr. Holloway said that with being a PUD that these concerns could <br /> Be regulated. <br /> Pete Fowley spoke on behalf of neighbors in the area of the PUD-E. Concerns were <br /> density, which would bring a high number of cars as well as children with no place to <br /> play. The configuration of the parking lot would make it difficult for fire and emergency <br /> equipment to be effective. Mr. Fawley also expressed concern about set backs, not being <br /> as they should be. Neal Almond a resident of North Indiana Street, said that he bought his <br /> home because of the neighborhood, he had checked the zoning of this ground before <br /> buying his home. He was also concerned about what people would think about seeing <br />
