" ORDINANCE NO. 7, 2008 • BEFORE THE TOWN COUNCIL OF MOORESVILLE, INDIANA UPON THE APPLICATION OF: Donald R, and Susan Lynn Adams, Terry C. and Sandra Kay Van Winkle, and Springhill Christian Ministries, Inc. AN ORDINANCE REZONING LAND WITHIN THE JURISDICTION OF THE TOWN OF MOORESVILLE, INDIANA WHEREAS, a public hearing was held the 27th day of March, 2008, with notice given as required by the Town Zoning Ordinance upon the application of Don Adams, for the rezoning of the real property described on the attached EXHIBIT `A' Legal Description and Exhibit `B' PUD Plat. WHEREAS, pursuant to Indiana Code 36-7-4 the Mooresville Plan Commission made a favorable recommendation to the Mooresville Town Council for said rezoning request from Ag & B-2 to PUD Industrial. NOW WHEREAS, the Mooresville Town Council, after diligent review of the matters pertaining to rezoning of the above described land at a public meeting held on the 15th day of April, 2008 find that the requested zoning classification is appropriate subject to the following voluntary conditions and restrictions which are to run with the land: 1). Maintenance and upkeep of the emergency access drive shall be on a share and share alike basis among the owner's of all lots in Block "A" and Block "B";
