\ yr/ - STATE OF INDIANA ) TOWN OF MOORESVILLE COUNTY OF MORGAN ) ORDINANCE 2008- /C VACATING A PORTION OF AN ALLEY WITHIN THE TOWN OF MOORESVILLE INDIANA WHEREAS, a public hearing was held on the -7` ` day of October, 2008 with notice by certified mail to abutting land owners as by law provided. A publication in the Mooresville Times, a newspaper or general circulation in Morgan County, Indiana appearing in the English language as by law provided; and, WHEREAS, the Petitioner, American Legion Post#10.3 presented evidence at a public hearing that the Post is the owner of Lots #3 and#4 of Block 14 of Samuel Moore's Second Addition to the Town of Mooresville, as per plat recorded in Deed Record "H", Page 139 in the Office of the Recorder of Morgan County, Indiana; and, WHEREAS, pursuant to LC. 36-7-3-12 Petitoner made valid application to the Town Board of the Town of Mooresville, stating it is the owner of property abutting, said alley, on each side and further the circumstances of such request to vacate such alley is presented to the Town Board, along with the names and addresses of abutting land owners and that all notices giving notice to such land owners and publication as by law provided, were made according to law; and, WHEREAS, the Mooresville Town Board reviewed such petition and all of them, testimony and evidence presented and support such petition; and, WHEREAS, any person opposing such petition were given an opportunity to presentation in opposition of such petition; and, WHEREAS, the Town Board of the Town of Mooresville now finds it is in the best interest that the alley way lying between lots# 3 and# 4 of Block 14 in the Samuel Moore's Second Addition to the Town of Mooresville more specifically described as follows: Starting at the southwest corner of Lot #4 of Block#14 in the Samuel Moore's Second Addition to the Town of Mooresville; thence west on the south line of said Block 14 sixteen (16)feet to the southeast corner of Lot #3 of Block 14 of the Samuel Moore's Second Addition; thence north 00 degrees 1 minute 53 seconds west, 157 feet to the northeast corner of said Lot #3; thence east sixteen (16)feet to the northwest corner of Lot #4 of said Block 14; thence south 00 degrees 1 minute 53 east, 157 feet along the west line of said Lot #4 to the southwest corner of said Lot #4 and the point of beginning.
