410 <br /> ORDINANCE 12 , 2004 <br /> BEFORE THE TOWN COUNCIL OF MOORESVILLE, INDIANA <br /> UPON THE APPLICATION OF: ARVIN HOPKINS <br /> AN ORDINANCE REZONING LAND WITHIN <br /> THE JURISDICTION OF THE TOWN OF MOORESVILLE <br /> WHEREAS, a public hearing was held the 22nd day of April, 2004, with <br /> notice given as required by the Town Zoning Ordinance, upon the Application <br /> of Arvin Hopkins for the rezoning of the real property described in the <br /> attached Exhibit "A"; <br /> WHEREAS, pursuant to Indiana Code 36-7-4, the Mooresville Plan <br /> Commission made a favorable recommendation to the Mooresville Town Council <br /> for said rezoning request from B-3 to I-1 with the following restrictions: <br /> The I-1 use excludes any penal or correctional institution, commercial <br /> facility for breeding non-farm fowl and animals, commercial slaughterhouse <br /> or mineral extraction. <br /> NOW WHEREAS, the Mooresville Town Council, after diligent review of the <br /> matters pertaining to rezoning of the above-described land at a public <br /> meeting held on the 18th day of May, 2004, find that the requested zoning <br /> classification is appropriate with the restrictions set out above. <br /> NOW, THEREFORE, BE IT HEREBY ORDAINED that the zoning classification of <br /> I-1 with the following restrictions: no penal or correctional institution, <br /> commercial facility for breeding non-farm fowl and animals, commercial <br /> slaughterhouse or mineral extraction shall be allowed: subject to the above <br /> restrictions the I-1 zoning classification shall hereinafter apply to the <br /> above-described real property and the Zoning Ordinance for the Town of <br /> Mooresville shall be amended to show and reflect said zoning use for the <br /> *real property described above effective June 15, 2004 . <br /> S <br />
