01, b. All prohibited substances listed in <br /> Part <br /> III . B. 1 . a above, such that the following are <br /> limited: <br /> (1 ) a pollutant contributed by an Industrial <br /> User that has caused or is likely to cause <br /> interference or pass through at the <br /> receiving POTW; and <br /> (2) the recurrence of the contributed <br /> pollutant' s affect on the POTW. <br /> c . The POTW shall have the legal authority to do all <br /> of the following : <br /> (1 ) enforce specific limits on prohibited <br /> substances as set out in this Ordinance and <br /> all Amendments hereto; <br /> (2 ) Section 502 "Penalties" is hereby amended to <br /> read the following: 502 . 1 Civil Penalties . <br /> Any discharger who is found to have violated <br /> an Order of the authority or who has failed <br /> to comply with any provision of this <br /> Ordinance, and the regulations or rules of <br /> the authority, or orders of any Court of <br /> competent jurisdiction may be subjected to <br /> imposition of a civil penalty (fine) of at <br /> least One Thousand Dollars ($1, 000 . 00) per <br /> day per violation in accordance with 40 CRP' <br /> 403 . 8 (f) (1) (vi) (A) as a violation of this <br /> Ordinance but no more than Two Thousand Five <br /> Hundred Dollars ($2, 500 . 00) per day, per <br /> violation, for a first violation nor more <br /> than Seven Thousand Five Hundred Dollars <br /> ($7, 500 . 00) per day, per violation, for <br /> subsequent violations, in accordance with IC <br /> 36-1-3-8 (a) (10) (B) . <br /> (3) The balance of Section 502 of Ordinance 17, <br /> 1989, in particular 502 . 2 and 502 . 3 shall <br /> remain unchanged. All other portion of <br /> Ordinance 17 , 1989 not conflicting with this <br /> Amendment will be in full force and effect <br /> and remain unchanged. <br />
