<br /> AN ORDINANCE AUTHORIZING THE ACQUISITION,
<br /> CONSTRUCTION AND INSTALLATION BY THE TOWN OF
<br /> MOORESVILLE, MORGAN COUNTY, INDIANA, OF CERTAIN
<br /> IMPROVEMENTS AND EXTENSIONS TO THE TOWN'S SEWAGE
<br /> WORKS, THE ISSUANCE AND SALE OF REVENUE BONDS TO
<br /> PROVIDE FUNDS FOR THE PAYMENT OF THE COSTS THEREOF,
<br /> THE ISSUANCE AND SALE OF BOND ANTICIPATION NOTES IN
<br /> ANTICIPATION OF THE ISSUANCE AND SALE OF SUCH BONDS AND
<br /> THE COLLECTION, SEGREGATION AND DISTRIBUTION OF THE
<br /> REVENUES OF SUCH SEWAGE WORKS AND ALL MATTERS
<br /> RELATED THERETO.
<br /> WHEREAS, the Town of Mooresville, Morgan County, Indiana (the "Town"), has
<br /> heretofore established and constructed and currently owns and operates a sewage works for the
<br /> collection and treatment of sewage and other wastes (the "Sewage Works"), pursuant to the
<br /> provisions of Indiana Code 36-9-23, as amended (the"Act"); and
<br /> WHEREAS, the Town Council of the Town (the "Town Council") hereby finds that
<br /> certain improvements and extensions to the Sewage Works are necessary; further, that HNTB
<br /> Corporation, Indianapolis, Indiana, the consulting engineers contracted by the Town (the
<br /> "Consulting Engineers"), have prepared and filed plans, specifications, detailed descriptions and
<br /> estimates of the costs of such improvements and extensions to the Sewage Works, which plans,
<br /> specifications, descriptions and estimates, to the extent required by law, have been duly
<br /> submitted to and approved or will be approved by all governmental authorities having
<br /> jurisdiction thereover (the improvements and extensions to the Sewage Works as described in
<br /> such engineers' plans and specifications and in SECTION 2 of this Ordinance (and as more fully
<br /> set forth in the Financial Assistance Agreement (as hereinafter defined), and any amendment
<br /> thereto, attached hereto and made a part hereof) are referred to herein as the "Project"); and
<br /> WHEREAS, the Town Council further finds that the estimates prepared and delivered by
<br /> 0 the Consulting Engineers with respect to the costs (as defined in Indiana Code 36-9-23-11) of
<br /> acquisition, construction and installation of such improvements and extensions to the Sewage
<br /> Works (as defined in Indiana Code 36-9-1-8, as amended, and in the Act), and including all
<br /> authorized costs relating thereto, including the costs of issuance of bonds and, if necessary, bond
<br /> anticipation notes (the "BANs") on account of the financing of all or a portion thereof, will be in
<br /> an amount not to exceed Nineteen Million Six Hundred Thousand Dollars ($19,600,000); and
<br /> WHEREAS, the Town Council hereby finds that to provide funds necessary to pay for
<br /> the costs of the Project, it will be necessary for the Town to issue sewage works revenue bonds
<br /> in an amount not to exceed Nineteen Million Six Hundred Thousand Dollars ($19,600,000) and,
<br /> if necessary, BANs in an amount not to exceed Nineteen Million Six Hundred Thousand Dollars
<br /> ($19,600,000); and
