ORDINANCE , 2011 <br /> AN ORDINANCE GRANTING <br /> TOWN EXECUTIVE CERTAIN POWERS <br /> WHEREAS, pursuant to IC 36-5-2-2 the Town Council is the <br /> elected legislative body of the municipality and the President <br /> of the Town Council pursuant to IC 36-5-2-7 is the Town <br /> Executive; <br /> WHEREAS, pursuant to IC 36-5-2-9 "Powers of Legislative <br /> Body" the Town Council may adopt Ordinances and Resolutions for <br /> performance of functions of the Town; purchase, hold, convey any <br /> interest in property, for the use of the Town; and, adopt and <br /> use a common seal; <br /> WHEREAS, the President of the Town Council pursuant to IC <br /> 36-5-2-7 shall be selected from one of its members to be its <br /> President for a definitive term which may not exceed his term of <br /> office as a member of the Council; <br /> WHEREAS, under the Home Rule Statute the policy of the <br /> State is to grant the local units the powers that they need for <br /> the effective operation of government as to local affairs (IC <br /> 36-1-3-2) and further that under IC 36-1-3-3 the rule of law <br /> that any doubt as to the existence of a power of a unit shall be <br /> resolved against its existence is abrogated and now the doubt as <br /> to the existence of a power of a unit shall be resolved in favor <br /> of its existence; <br />
