r, <br /> ORDINANCE /0 , 2012 <br /> AN ORDINANCE AMENDING ORDINANCE 8, 2012 <br /> AN ORDINANCE ANNEXING REAL PROPERTY CONTIGUOUS TO <br /> THE CIVIL TOWN OF MOORESVILLE <br /> WHEREAS, the initial Ordinance 8, 2012 passed May 15, 2012 <br /> contained a <br /> scrivener' s error as to the owner and Petitioner for <br /> annexation listed as J & J Commercial Investments, Inc. pursuant <br /> to their original Petition for Annexation; <br /> WHEREAS, the actual owner of record is one and the same <br /> entity but known as J & J Commercial Investments, LLC; <br /> WHEREAS, the purpose of this Amendment to Ordinance 8, 2012 <br /> is to give the correct owner and legal description with all <br /> other aspects of Ordinance 8, 2012 being compliant with <br /> statutory requirements; <br /> WHEREAS, the Town did proceed and adopt a Fiscal Plan based <br /> upon the real property described in the attached Exhibit "A"; <br /> WHEREAS, proper notice was given and the public hearing was <br /> held based upon the legal description and not ownership; <br /> WHEREAS, all of the requirements of IC 36-4-3-5 . 1 have been <br /> met as a pre-requisite for the annexation of the real property <br /> described in the attached Exhibit "A"; <br /> NOW, THEREFORE, BE IT HEREBY ORDAINED by the Town of <br /> Mooresville through its Town Council that the real property <br /> IIIdescribed in the attached Exhibit "A" shall be annexed to the <br />
