He further stated that the Becks reside in the residence <br />beside the building which is all included within the 1.24 acre tract in question. <br /> <br /> Mr. Lawson then stated that the normal business hours were 8:00 o'clock <br />to 5:00 o'clock during the week with some Saturday and Sunday hours and an <br />occasional person coming after hours to return items rented or request a rental <br />of an emergency item. In addition he stated that the business would need a <br />sign and had been in contact with the state to see what requirements they would <br />have as to a setback. In addition he stated there was only one home you could <br />see from the business location and that was across the street, a party who <br />frequently used some of their services. He further stated that 22 adjoining <br />property owners had been notified. Attorney Lawson then pointed out other <br />businesses in the area including the sand and gravel operation and felt for this <br />reason that the proposed use would not be injurious to the general area. <br /> <br /> Chairman Oschman then opened up the floor for statements by remonstrators. <br />Kay Smitherman of 553 State Road 267 stated that she lived on the east side of <br />the road and that she and her husband, Bruce, had brought the violation to the <br />Plan Commission's attention in the spring of 1984. Mrs. Smitherman advised <br />that she had resided with her husband in their home since 1959 and had a fear <br />that this type of rezoning could be the start of several rezonings creating a <br />business pathway from the IGA in Mooresville on out of State Road 267 to E-Z <br />Way Rental and beyond. She also stated that originally Mr. Hopkins had told <br />the Morgan County Plan Commission in 1964 that he would be using this area for <br />residential which would result in finer homes than "you now live in being <br />built on this property". <br /> <br /> The next person to speak was Samuel Craver, 231 Whitlick Road. His <br /> concern was that additional businesses would contaminate the adjoining ponds <br /> and pollute the wells for property owners such as himself.
