<br />ORDINANCE ) / <br /> <br />,1999 <br /> <br />BEFORE THE TOWN COUNCIL OF THE CIVIL TOWN OF MOORESVILLE <br />AN ORDINANCE REZONING LAND WITHIN THE JURISDICTION <br />OF THE TOWN OF MOORESVILLE <br /> <br />WHEREAS, a hearing was held by the Mooresville Plan Commission with notice given <br /> <br />as required by the Town Ordinance upon the application of Sugarwood, LLC, for rezoning of <br /> <br />the following described land from its present classification of A-I Agricultural to that of R-3 <br /> <br />Residential with restrictions to run with the land on the real property more particularly described <br /> <br />as Lot 2 Sugarwood Minor Plat, a Minor Plat in Morgan County, Indiana containing 1.199 acres <br /> <br />(legal description of Lot 2 is attached hereto and made a part hereof as Exhibit" A"); <br /> <br />WHEREAS, the Town Council for the Civil Town of Mooresvi1le has reviewed the <br /> <br />rezoning request and finds it consistent with the Mooresvi1le Master Land Use Plan; <br /> <br />WHEREAS, Petitioner has agreed to certain stipulations to run with the land and to limit <br /> <br />the use under a zoning classification of R-3, more particularly that the use is restricted to a <br /> <br />residential use for the mentally handicapped only and not to be opened up to a general R-3 use <br /> <br />for the public. <br /> <br />NOW, THEREFORE, be it ordained that the zoning cJassification ofR-3 shall hereinafter <br /> <br />apply to the real property described as Lot 2, Sugarwood Minor Plat and that this zoning <br /> <br />classification shall be further restricted to apply only for the use of residential apartment uses <br /> <br />for the mentally handicapped and not a general R-3 use for the public; the zoning ordinance for <br /> <br />the Town of Mooresville is amended to show said zoning for the property set out above, <br /> <br />This Ordinance is approved this 6th day of July, 1999 and signed this 17th day of <br /> <br />August, 1999, <br />
