'- ~ ORDffiANCENUMBERÂ/-/rrl' ORDiNANCE OF THE TOWN COUNCIL OF THE TOWN OF MOORESVILLE, MORGAN COUNTY, INDIANA, REGARDiNG REZONING OF HOPKINS, CAPERTON, STAFFORD DEVELOPMENT, iNC., AND ARVIN HOPKINS AND MARY L. HOPKINS PROPERTY WHEREAS, the Town Council of the Town ofMooresville has the authority under I.C. 36- 7-4-607, to amend it current zoning ordinance; WHEREAS, in accordance with 1.c. 36-7-4-405, the Mooresville Town Plan Commission conducted a public hearing on October 6, 1998, concerning the rezoning of certain property owned by Hopkins, Caperton, Stafford Development, Inc., and Arvin Hopkins and Mary L. Hopkins, Husband and Wife, and such property more specifically described in Exhibit "A" attached hereto, and such property being currently zoned Mt f! ¿( ß - (Z WHEREAS, the Town Council of the Town of Mooresville has decided that the Petition for rezoning the above described property is accordance with the comprehensive plan and with the Mooresville Town Zoning Ordinance as it currently exists, and having found that it is the best use of the land for the property to be rezoned ftom its current zoning of A-l to POO-Residential and has found in all other ways that it is in the best interest of the public and the Town ofMooresville to have this rezoning take effect at this time; NOW, THEREFORE, BE IT ORDAINED BY THE TOWN COUNCIL OF THE TOWN OF MOORESVILLE, MORGAN COUNTY, INDIANA, that: SECTION 1. The property which is more specifically described in the attached Exhibit "A" and owned by Hopkins, Caperton, Stafford Development, Inc., and Arvin Hopkins and Mary L. Hopkins, Husband and Wife, is hereby rezoned to the zoning category of Planned Unit Development- Residential (POO-R), consistent with the Mooresville Town Zoning Ordinance which is currently in effect under Section 6.1 A. SECTION n. This ordinance shall be in full force and effect from and after its passage and promulgation.
