HOPKINS PROPERTY <br /> <br />WHEREAS, the Town Council of the Town of Mooresville has the authority under LC. 36- <br />7-4-607, to amend it current zoning ordinance; <br /> <br />WHEREAS, in accordance with LC. 36-7-4-405, the Mooresville Town Plan Commission <br />conducted a public hearing on October 6, 1998, concerning the rezoning of certain property owned <br />by Hopkins, Caperton, Stafford Development, inc., and Arvin Hopkins and Mary 1. Hopkins, <br />Husband and Wife, and such property more specifically described in Exlùbit "A" attached hereto, <br />and such property being currently zoned N4-( Ptlþ - 12- <br /> <br />WHEREAS, the Town Council of the Town of Mooresville has decided that the Petition for <br />rezoning the above described property is accordance with the comprehensive plan and with the <br />Mooresville Town Zoning Ordinance as it currently exists, and havi~l<>'jfd that it is the best use of <br />the land for the property to be rezoned from its current zoning of'i!iJ!J.Þto PUD-Residential and has <br />found in all other ways that it is in the best interest of the public and the Town of Mooresville to have <br />this rezoning take effect at this time; <br /> <br />NOW, THEREFORE, BE IT ORDAINED BY THE TOWN COUNCIL OF THE TOWN OF <br />MOORESVJLLE, MORGAN COUNTY, iNDIANA, that: . <br /> <br />SECTION L The property which is more specifically described in the attached Exlùbit "A" <br />and owned by Hopkins, Caperton, Stafford Development, Inc., and AlVin Hopkins and Mary 1. <br />Hopkins, Husband and Wife, is hereby rezoned to the zoning category of Planned Unit Developrnent- <br />Residential (PUD-R), consistent with the Mooresville]:!>wn Zoning Ordinance which is currently in <br />effect under Section 6.1 A. <br /> <br />SECTION n. This ordinance shall be in full force and effect from and after its passage and <br />promulgation. <br />
