<br />1~<9' <br /> <br />9'700624 <br /> <br />8ook3C\3 Page <br /> <br />55i <br /> <br />RIGHT-OF-WAY EASEMENT <br /> <br />This easement, made this <br /> <br />"11... r <br />/ ~ - day of -Je .ð7f'/h6'f'A' <br />, <br /> <br />, 1996, by and <br /> <br />between the Mooresville Consolidated School Corporation of Morgan County, State of Indiana <br /> <br />(hereinafter referred to as "Grantor"), and the Civil Town of Mooresville (hereinafter referred <br /> <br />to as "Grantee"), <br /> <br />WITNESSETH: That the Grantor, in consideration of certain work and installation being <br /> <br />done by Grantee and for other valuable consideration, the receipt whereof is hereby <br /> <br />acknowledged, now grants to Grantee, Grantee's successors and assigns, a right-of-way easement <br /> <br />to install, construct, replace, repair, inspect, maintain, renew and remove such existing sidewalk <br /> <br />as is necessary for installation of new a sidewalk and grants a right-of-way easement for the <br /> <br />purposes of maintaining sidewalks and appurtenant supporting apparatus as deemed necessary <br /> <br />at the option of Grantee through a strip of land described in the attached Exhibit" A", which is <br /> <br />attached hereto and made a part hereof. <br /> <br />That Grantor's parcel of real estate is more particularly described in the Deed of record <br /> <br />in which Grantor came into title of said real estate shown in the Morgan County Recorder's <br />1~7 - 3c.¡f: /,ÿ'--¡ -<"-7'~ / c'/) /" D ' <br />, ,~/ " ~ - - ¿. Along with the easement granted as set out above Grantor further grants a non-exclusive <br /> <br />right-of-way and easement for the passage of men, vehicles and machines to accomplish all of <br /> <br />the purposes set out above. Grantee shall conduct its operation in such a way as not to <br /> <br />-~ <br /> <br />unreasonable interfere with Grantor's use of the ground and Grantee further covenants to restore <br /> <br />the easement to the condition it was prior to any work performed on Grantor's property. <br />
