AN ORDINANCE TO REZONE CERTAIN REAL ESTATE UPON THE APPLICATION OF EUGENE PERRY WHEREAS, the Advisory Planning Act of the State of Indiana, has found that Indiana Code 36-7-4 and thereafter provides for the establishment and implementation of advisory planning commis- sions in local government agencies throughout the State of Indiana, and the provisions of said Act include the procedures for appli- cation for rezoning, notice to interested parties, and hearing on same, and, WHEREAS, the Town of Mooresville has duly enacted and pro- mulgated its ordinance for the development through planning and zoning of the area within the jurisdiction of the planning commis- sion of the Town of Mooresville, known as the "Zoning Ordinance In Moorosville, Indiana" and, WHEREAS, application was duly made, notices given, and hearing held on April 28, 1994, and, WHEREAS, the Planning Commission of the Town of Mooresville recommended the change in zoning from classification R-l to 1-1 NOW, THEREFORE, BE IT ORDAINED as follows: 1. That the zoning classification applicable to the below described real estate shall be hereafter rezoned from R-1 to 1-1 Lot Number Thirteen (13) and a part of Lots Number Eleven Ill) and Twclve (12) in Glendale, an Addition to the Town of Mooresville, as per plat thereof recorded in Deed Record 81, page 155, in the Office of the Recorder of Morgan County, Indiana, that portion of Lots Number Eleven (11) and Twelve (12) being described as follows: Lots Number Eleven (11) and Twelve (12) except the following described parcel: begin- ning 200.0 feet East of the Southwest corner on the South line of Lot Eleven 111) at the Southeast corner of a tract recorded in Deed Record 201, page 227; run thence Northerly and parallel to the West lines of Lots Eleven (11) and Twelve (12) for 200.0 feet into Lot Twelve (12); run thence East- erly and parallel to the South line of Lot Eleven (11) for 130.0 feet to the East line of Lot Twelve (12); run thence Southerly on the East lines of Lots Twelve (12) and Eleven Ill) for 200.0 feet to the southeast corner of Lot Eleven (11); run thence Westerly on the South linc of Lot Eleven (11) for 130.0 feet to the place of beginning. The zoning map of the Town of Mooresville and the zonIng ordinance of the Town of Mooresville shall be hcreafter amended to rcflect thc above classification of zoning.
