<br />I <br /> <br />ORDINANCE NO. <br /> <br />} :~. !4f1 't <br /> <br />BEFORE THE MOORESVILLE TOWN COUNCIL <br /> <br />UPON THE APPLICATION OF: <br />MOORESVILLE PARTNERS, INC. <br /> <br />AN ORDINANCE REZONING LAND WITHIN THE <br />TOWN OF MOORESVILLE UPON THE APPLICATION <br />OF MOORESVILLE PARTNERS, INC. <br /> <br />WHEREAS, a hearing was held the 25th day of August, 1994, <br />with notice given as required by ordinance upon the application of <br />Mooresville Partners, Inc., for rezoning of the following described <br />land from its present classification of Agricultural to that of <br />Business-3; <br />WHEREAS, the Planning Commission of the Town of Mooresville <br />did recommend approval of said rezoning, pursuant to the proce- <br />dures and ordinances of the Town and pursuant to I.C. 36-7-4-608; <br />NOW, THEREFORE, BE IT ORDAINED that the zoning classification <br />of B-3 shall hereafter apply, and the Zoning Ordinance of the <br />Town of Mooresville is amended to show said zoning for the fol- <br />lowing described real estate located in the Town of Mooresville, <br />Morgan County, Indiana: <br /> <br />A part of the North half of the Northeast quarter of <br />Section 31, Township 14 North, Range 2 East of the Second <br />Principal Meridian in Morgan County, Indiana, being more <br />particularly described as follows, to-wit: <br /> <br />Commencing at a stone marking the Northeast corner of <br />said half quarter section; thence South 87 degrees 39 <br />minutes 30 seconds West, along the North line of said <br />half quarter section, a distance of 1332.31 feet; thence <br />South 00 degrees 20 minutes 00 seconds west, a distance <br />of 30.02 feet to an iron pin on the South right-of-way <br />of Bridge Street and the POINT OF BEGINNING of this <br />description; thence South 00 degrees 16 minutes 26 seconds <br />West; along the East line of said plat, 321.64 feet to <br />an iron pin; thence South 87 degrees 39 minutes 30 seconds <br />West, 789.13 feet to a 5/8" rebar at the point of curva- <br />ture of a curve to the right, concave easterly having a <br />radius of 275.00 feet, a central angle of 020 degrees 30 <br />minutes 00 seconds, a chord of 97.87 feet, a tangent of <br />49.73 feet; thence along said curve, 98.39 feet to a <br />5/8" rebar at the point of tangency of said curve; thence <br />North 02 degrees 20 minutes 30 seconds East, 224.99 feet <br />to a 5/8" rebar on aforesaid right-of-way; thence North <br />87 degrees 39 minutes 30 seconds East, along right-of-way <br />821.23 feet to the POINT OF BEGINNING of this description. <br />Containing 5.99 acres, more or less, and being subject <br />to all legal highways, rights-of-way and easements of <br />record. <br /> <br />l <br />
