ORDINANCE NO. D - ]993 <br /> <br />AN ORDINANCE RESTRICTING USE OF PUBLIC FIRE HYDRANTS <br /> <br /> WHEREAS, the Civil Town of Mooresville, pursuant to Indiana <br />Code 36-1-32 has the authority to pass ordinances necessary to <br />affect the operation of the local government and to provide for <br />the health and safety of the citizens of the Civil Town of <br />Mooresville; <br /> <br /> WHEREAS, the Civil Town of Mooresville has received a request <br />from the Hoosier Water Company, Inc. concerning the use of public <br />hydrants; BE IT HEREBY ORDERED AND ORDAINED as follows: <br /> <br /> ]. That the Civil Town of Mooresville shall restrict the use <br />of any public fire hvdrant, public fire hydrant being defined as <br />any fire hydrant located on the right-of-way of the Civil Town of <br />Mooresville, to representatives of the Mooresville Fire and Street <br />Departments or the Hoosier Water Company employees, their <br />engineers, or contractors. <br /> <br /> 2. That anyone desiring to use a public hydrant shall first <br />contact the Mooresville Fire Department and request permission to <br />have the fire department meet them to open the hydrant. In the <br />event of an emergency, the Mooresville Police Dispatcher shall be <br />contacted for a representative of the Mooresville Fire Department <br />to be present to open the hydrant and the party using the water <br />shall keep records on the amount used and turn the same into the <br />Hoosier Water Company, Inc. or its successors and assigns. <br /> <br /> 3. In the event of non-emergency situations, the Mooresvi]le <br />Fire Department shall refer the request to the Hoosier Water <br />Company to allow them to make arrangements for obtaining the water <br />through the hydrant located at the Hoosier Water Company's main <br />office in Mooresville. <br /> <br /> 4. That the penalty for violation of this ordinance shall be <br />~ fine of not less than $25.00 nor more than $~,000 along with any <br />damages to the hydrant, cost of water, and any court costs. <br /> <br /> 5. That violations of this ordinance shall be cited into the <br />Mooresville Town Court by the Mooresville Town Marshall's office <br /> <br /> <br />
