ORDINANCE 5 1993 <br /> <br />AN ORDINANCE FOR FIRE PROTECTION <br /> <br />SERVICE CHARGES <br /> <br /> WHEREAS, pursuant to IC 8-]-2-103; IC 8-].504-14; IC 8-1.5-5; <br />IC 36-3-2-10; IC 36-9-26-11.5 grants to municipalities which <br />provide fire protection service the authority to adopt an <br /> <br />ordinance to recover the cost <br />water service rate applicable <br />municipality. <br /> <br /> WHEREAS, the Civil Town of Mooresville does provide <br /> <br />of the service through the general <br />to the residents of the <br /> <br />fire <br /> <br />protection service to it's residents and desires to recover the <br />cost of the fire hydrant rental by passing an ordinance to allow <br />the water utility serving the residents to adjust their rate to <br />recapture the cost of the fire protection services and pass it on <br />to the users of said utility. <br /> <br /> NOW, THEREFORE, BE IT HEREBY ORDAINED that the Civil Town of <br />Mooresville shall notify all utilities providing water service to <br />the Town for fire protection that the charges for said fire <br />protection service shall be recovered through the general water <br />service applicable to the residents. <br /> <br /> BE IT FURTHER RESOLVED, that the effective date of this <br />ordinance shall be January 1, ]994. Starting with the first day <br />of January, ]994 all water utilities which provide fire protection <br />service to the Town of Mooresville shall be responsible for <br />adjusting their water service rates to allow for the recovery of <br />the cost of fire protection service to be charged to the utility <br />users and no fire hydrant rental shall be paid by the Town of <br />Mooresville for fire protection services. <br /> <br /> That this ordinance shall become effective immediately and <br /> notice shall be given to all water utilities serving the residents <br /> of the Town of Mooresville upon the date of final passage. <br /> <br /> PASSED this /~ ~ day of August, 1993. <br /> <br />TOWN COUNCIL <br />CIVIL TOWN OF MOORESVILLE, <br /> <br /> <br />
