<br />ORDINANCE NO. ~ - 1989 <br />AN ORDINANCE CREATING A HANDICAPPED PARKING AREA <br /> <br />BE IT ORDAINED by the Town Council of the civil Town of <br />Mooresville, Indiana, that: <br />By the powers vested in said Town Council for the Civil Town <br />of Mooresville, Indiana, it is hereby ordered and ordained that: <br />WHEREAS, it is necessary to control the parking within the <br />Town of Mooresville, Indiana, and to provide suitable parking <br /> <br />spaces for handicapped persons within the Town of Mooresville in <br /> <br />areas where marked handicapped parking is necessitated by traffic <br />and parking patterns. <br />IT IS HEREBY ORDERED AND ORDAINED THAT <br />1. The Street Commissioner shall have the authority to <br />establish handicapped parking areas within the civil Town of <br />Mooresville and to mark said handicapped parking spots by sign <br />or other means which openly display that said area is a <br />handicapped parking space. <br />2. That no person shall park a vehicle in a handicapped <br />parking space which is designated by the Street Commissioner and <br />marked unless the individual is driving a vehicle which does have <br />the designated handicapped license plate displayed on the license <br />plate. <br />3, VIOLATION OF THIS ORDINANCE - A violation of this <br />ordinance shall be punishable by a fine of not less than One <br />Dollar ($1.00) or more than Twenty-five Dollars ($25.00) per <br />violation and in addition a vehicle parked in the spot which docs <br />not have the designated handicapped license plate shall be subject <br />to being removed by an order from the Town Marshall's office with <br />the car owner being responsible for the cost of the vehicle being <br /> <br />towed, storage, and any and all other related costs associated <br /> <br />with the removal of said vehicle, along with the fine set out <br /> <br />above. <br /> <br />4. Whereas an emergency exists and this ordinance is <br /> <br />declared to be in full force and effect on passage of the same and <br /> <br />the Clerk-Treasurer is directed to publish said ordinance. <br />
