<br />I <br /> <br />502.3 <br /> <br />by the Civil Town of Mooresville through the State <br />of Indiana or the federal Environmental Protection <br />Agency that are a direct result of the violation of <br />the Discharger. <br /> <br />Falsifying Information. Any person who knowingly <br />makes any false statement, representation or <br />certification in any application, record, report, <br />plan or other document filed or required to be <br />maintained pursuant to this Ordinance, or who <br />falsifies, tampers with, or knowingly renders <br />inaccurate any monitoring device or method required <br />under this Ordinance shall, upon conviction, be <br />punished by the imposition of a civil penalty of <br />not more than $2,500. <br /> <br />601. Records Retention. <br /> <br />601.1 <br /> <br />All Dischargers subject to this Ordinance shall <br />retain and preserve for no less than three (3) <br />years, any records, books, documents, memoranda, <br />reports, correspondence, and any and all summaries <br />thereof, relating to monitoring, sampling and <br />chemical analysis made by or in behalf of a <br />Discharger in connection with its discharge. All <br />records which pertain to matters which are the <br />subject of Administrative Adjustment or any other <br />enforcement or litigation activities brought by the <br />Authority pursuant hereto shall be retained and <br />preserved by the Discharger until all enforcement <br />activities have concluded and all periods of <br />limitation with respect to any and all appeals have <br />expired. <br /> <br />701. Miscellaneous. <br /> <br />701.1 <br /> <br />701.2 <br /> <br />Removal Credits. Where applicable, the Authority <br />may elect to initiate a program of removal credits <br />as part of this Ordinance to reflect the POTW's <br />ability to remove pollutants in accordance with 40 <br />CFR Part 403.7. <br /> <br />Net/Gross Calculations. The Authority may elect to <br />adjust Categorical Pretreatment standards to <br />reflect the presence of pollutants in the <br />Discharger's intake water, in accordance with 40 <br />CFR Part 403.15. <br /> <br />SOl. Severability. <br /> <br />SOl.1 <br /> <br />901. Conflict. <br /> <br />901.1 <br /> <br />If any provision, paragraph, word, section or <br />chapter of this Ordinance is invalidated by any <br />court of competent jurisdiction, the remaining <br />provisions, paragraphs, words, sections, and <br />chapters shall continue in full force and effect. <br /> <br />All other ordinances and parts of other ordinances <br />inconsistent or conflicting with any part of this <br />Ordinance are hereby repealed to the extent of such <br />inconsistency or conflict. <br /> <br />-26- <br />
