<br />I <br /> <br />RES 0 L UTI 0 N <br /> <br />..J ~/ <br />~ <br /> <br />BE IT HEREBY RESOLVED by the Board of Trustees of the Civil Town of <br /> <br />Mooresvil1e, Morgan County, Indiana, that: <br /> <br />WHEREAS, <br /> <br />The Town passed a resolution on October 15, 1986, ordering the Trustee <br /> <br />of the terminated Town of Mooresville Employees Retirement Plan to distribute that <br /> <br />portion of the trust fund attributable to the employer contributions less any <br /> <br />earnings thereto to the employer, <br /> <br />WHEREAS, after discussion with the State Board of Accounts the Town <br /> <br />was advised to have the Trustee of the plan make said employer contribution <br /> <br />payable by the Trustee to the employees, <br /> <br />WHEREAS, the employer contribution consisted of the matching <br /> <br />contributions made by the employer to match the contributions of the employee <br /> <br />during the existence of the plan; and <br /> <br />BE IT THEREFORE RESOLVED, that the Trustee shall distribute the <br /> <br />employer contributions to the employees on a pro-rata basis to all participants <br /> <br />and beneficiaries in the case of any participant who has died and not received <br /> <br />a distribution under the plan as of such date of distribution to reflect that <br /> <br />part of the employer contribution which is matching monies to that employee's <br /> <br />contribution as shown in the records of said plan. <br /> <br />BE IT FURTHER RESOLVED, that any portions of this resolution that <br /> <br />are in conflict with the resolution dated October 15, 1986, from the Board <br /> <br />meeting of October 7, 1986, shall be overruled by the articles contained in <br /> <br />this resolution but shall in no other way have any effect whatsoever regarding <br /> <br />the matters set out in the resolution dated October 15, 1986. <br /> <br />I hereby certify that the foregoing is a true and exact copy of the <br /> <br />resolutions adopted by the Board of Trustees of the Civil Town of Mooresville <br /> <br />and that such resolutions are still in full force and effect. <br /> <br />IN WITNESS WHEREOF, I have signed this Resolution dated this <br /> <br />18th <br /> <br />day of November, 1986. <br /> <br />BOARD OF TRUSTEES <br />CIVIL TOWN OF MOORESVILLE, INDIANA <br /> <br />/d. ii~!
