<br />I <br /> <br />ORDER PURSUANT TO ORDINANCE NO. 1-1982 <br /> <br />Comes now the Civil Town of Mooresville by its Board of Trustees and <br /> <br />having heard evidence regarding the alleged offenses under Town Ordinance <br /> <br />No. 1-1982 by the Summit Finishing Company under Articles 224.5 and 247 with <br />said ordinance violations occurring on September 17, 1986; October 10, 1986; <br /> <br />October 19, 1986; and November 4, 1986; and having heard evidence from the <br /> <br />Town Sewer Treatment Plant Superintendent, Steve Orme regarding said alleged <br /> <br />violations and the related expenses occurring from said violation, and Summit <br /> <br />Finishing Company being present but presenting no rebuttal evidence the Town <br /> <br />now finds that said violations did occur on said dates set out as previously <br /> <br />detailed and finds that the expenses set out were incurred by the Civil Town <br /> <br />of Mooresville: <br /> <br /> <br />IT IS NOW THEREFORE ORDERED that Summit Finishing Company be assessed damages <br /> <br /> <br />totalling Sixteen Thousand Five Hundred and Five Dollars and Thirty-Four Cents <br /> <br /> <br />($16,505.34) for the expenses accruing to the Town for said violations and in <br /> <br /> <br />addition that they be fined a total of Forty-Dne Thousand Sixty-Two Dollars and <br /> <br /> <br />Fifty Cents ($4I,062.50) for the respective violations as set out under Article <br />II, Provisions 224.5 and the respective violations set out within said subsection <br /> <br />respectively as presented at the hearing and a total of Five Hundred Dollars <br /> <br />($500.00) for each violation of Section 247 as detailed at said hearing along <br />with an Order that all costs and fines for said violations be paid within <br /> <br />thirty (30) days from the receipt of this Order. <br /> <br />--- <br /> <br /> <br />DATED: December 29, 1986 <br /> <br />l <br />
