Hogston, <br /> <br />for the sole consideration of the sum of One Hundred Six Dollars ($106.00), <br /> <br />paid to the undersigned, the receipt of which is hereby acknowledged, hereby <br /> <br />forever releases and discharges the Civil Town of Mooresvil1e, its agents and <br /> <br />assigns and all other persons, firms or corporations liable, or who might be <br /> <br />liable, and none of whom admit any liability to the undersigned, but all <br /> <br />dispute any liability to the undersigned of and from any and all manner of <br /> <br />actions, causes of action, suits, accounts, claims, and demands whatsoever, <br /> <br />at law or in equity, and however arising, up to the date of these presents, <br /> <br />including particularly, any action or cause of action growing out of a tree <br /> <br />limb falling on a certain 1974 Chevrolet automobile of Edward L. Hogston <br /> <br />on Sunday, June 9, 1985 in the area of East Harrison Street in the Civil Town <br /> <br />of Mooresville, Indiana at Broad Alley, <br /> <br />It is understood and agreed that the payment of said amount is not to be <br /> <br />construed as an admission of liability, but that said payment is made and <br /> <br />accepted in full accord and in satisfaction of, and in compromise of, a disputed <br /> <br />claim, and for the purpose of terminating dispute and litigation between the <br /> <br />parties for any and all claims arising out of the events of June 9, 1985 involving <br /> <br />Edward L. Hogston and damage to his vehicle in the Civil Town of Mooresville. <br /> <br />It is further understood and agreed that this release extends to all claims of <br /> <br />every nature and kind whatsoever, known or unknown, suspected or unsuspected, <br /> <br />and that the undersigned is executing this release upon his own free will and <br /> <br />accord and is in no way relying on any representation made by the Civil Town of <br /> <br />Mooresville. <br /> <br />IN WITNESS <br /> <br />the signature of Edward L.
